เรื่อง แนวทางการก าหนดมาตรการป้องกันอาชญากรรมทางเศรษฐกิจข้ามชาติ
ที่มีผลกระทบต่อการท่องเที่ยว ศึกษากรณี “ทัวร์ผิดกฎหมาย”

การวิจัยครั้งนี้มีวัตถุประสงค์เพื่อศึกษารูปแบบ วิเคราะห์สภาพปัญหาและปัจจัยที่มี
ผลกระทบ และเสนอแนะแนวทางในการก าหนดมาตรการป้องกันปัญหาทัวร์ผิดกฎหมาย ขอบเขต
ของการวิจัยด้านเนื้อหาศึกษาการน านักท่องเที่ยวจากต่างประเทศเข้ามาท่องเที่ยวในประเทศไทย
ที่เป็นการกระท าผิดกฎหมาย ด้านประชากรท าการศึกษาจากบุคคลากรที่มีความรู้ความเชี่ยวชาญ
ด้านปัญหาการท่องเที่ยวจากหน่วยงานภาครัฐและเอกชนจ านวน 10 คน วิธีด าเนินการวิจัยเป็น
การวิจัยเชิงคุณภาพโดยการรวบรวมข้อมูลจากแนวคิด ทฤษฏี งานวิจัย ข้อมูลที่เกี่ยวข้อง และ
จากการสัมภาษณ์เชิงลึกกลุ่มประชากรเป้าหมายผลการศึกษาพบว่ารูปแบบของทัวร์ผิดกฎหมาย เป็น
การจัดบริการน าเที่ยวให้แก่นักท่องเที่ยวจากต่างประเทศที่เดินทางเข้ามาในประเทศไทย โดยผู้ประกอบการ
ฝ่ายไทยได้รับค่าบริการจากคู่ค้าในอัตราต่ ากว่าต้นทุน จ าแนกได้ 3 ระดับคือ “ทัวร์ต่ ากว่าทุน”,
“ทัวร์ศูนย์เหรียญ” และ “ทัวร์ติดลบ” ส่วนใหญ่เกิดขึ้นกับนักท่องเที่ยวจากจีน ผู้ประกอบการ
ฝ่ายไทยจะหารายได้เพื่อแสวงหาผลก าไรจากนักท่องเที่ยวด้วยวิธีต่างๆ เช่น การพาไปซื้อสินค้า
ในราคาที่สูงกว่าปกติเป็นต้น เป็นรูปแบบการประกอบธุรกิจท่องเที่ยวของจีนที่ท าในหลายประเทศ
มีกลุ่มธุรกิจชาวจีนเข้ามาด าเนินธุรกิจเกี่ยวกับการท่องเที่ยว โดยใช้คนไทยเป็นตัวแทนอ าพราง
(nominee) “ทัวร์ติดลบ” ก่อให้เกิดปัญหามากที่สุด ปัญหาที่ส าคัญคือ ภาพลักษณ์ด้านการท่องเที่ยว
ของไทยเสียหาย เกิดผลกระทบต่อธุรกิจท่องเที่ยวและเศรษฐกิจของประเทศ โดยปัจจัยที่ส่งผล
กระทบต่อทัวร์ผิดกฎหมายที่ส าคัญคือ นักท่องเที่ยวจีนมีจ านวนมากและเป็นตลาดเกิดใหม่มีความรู้
เรื่องการท่องเที่ยวน้อยนิยมซื้อทัวร์ราคาถูก จึงเกิดการแข่งขันแย่งตลาดนักท่องเที่ยวชาวจีน
ของฝ่ายไทย มาตรการในการแก้ไขปัญหาที่ส าคัญคือ การประชาสัมพันธ์ให้ข้อมูลแก่นักท่องเที่ยว
เป้าหมาย การตลาด และการแก้ไขกฎหมายให้ทันสมัยมีประสิทธิภาพ บังคับใช้กฎหมายอย่าง
จริงจังโดยเจ้าหน้าที่ต้องไม่เข้าไปมีส่วนรู้เห็นเป็นใจ มีข้อเสนอแนะในเชิงนโยบายที่น่าสนใจคือ
ควรจัดล าดับความเร่งด่วนในการแก้ไขปัญหาโดยน่าจะมุ่งไปที่“ทัวร์ติดลบ” ก่อนเนื่องจากเกิด
ความเดือดร้อนกับนักท่องเที่ยวอย่างชัดเจน และเพื่อมิให้กระทบต่อจ านวนนักท่องเที่ยวชาวจีน

ABSTRACT
Title Guidelines for the Preventive Measures of Transnational Economic Crime that
impacts on tourism: A Case Study on "Illegal Tours"

This research aims to study the analysis of the issues, factors, and suggested
guidelines for the prevention of illegal tours. The scope of the research content is to study the
illegal activity of inbound tourism in Thailand.
The research was conducted on a team of 10 tourism experts from the public and
private sectors. The research method was through qualitative research, by gathering information
from the related data reseach theory concerned, as well as, from in-depth interviews of the target
population.
The results of the study revealed that, the practice of providing “lower-than-cost”
tour services to foreign tourists arriving in Thailand by Thai operators, are illegal. The practice
can be classified into 3 levels, namely; “lower-than-cost” tours, “zero dollar” tours, and “kick
back” tours, the majority of the victims of which are mainly Chinese tourists.
Thai tour operator seek profits from tourists in various ways, such as taking them to
purchase goods at a higher price than what would be normally charged. It is a form of tourism
business in China, and practiced in many countries. There are also Chinese business groups
involved in the tourism business who employ Thais as nominees.
"Kick back tours" is the type that causes the most problems, which importantly,
damages Thailand's tourism image and has a major impact on the tourism industry, as well as the
economy. The major factor that affects illegal tours is due to the sheer volume of Chinese tourists
and the emerging markets, which has limited knowledge about tourism, prompting them to
purchase cheap tours. This situation creates intense competition for Chinese tourists in Thailand.
A broad number of measures are needed to solve the problem, which should involve providing
accurate tourism information, marketing management, amendments to the current laws and strict
law enforcement by the authorities. There is currently an interesting policy suggesting, that urgent
priority must be given to resolving the problem by first focusing on the "kick back tours" due to
its extensive tourist complaints, so as not to have an effect on the current number of Chinese
tourists visiting Thailand.
