วิธีปฏิบตัิทีÉเกีÉยวขอ้งของทางราชการ ตลอดจนเงืÉอนไขต่างๆทีÉจะตอ้งพิจารณา ซÉึงหน่วยทีÉมีหน้าทีÉใน
การจดั หาจะตอ้งปฏิบตัิโดยเคร่งครัดอีกทÊงัในการจดั หาอาวุธยทุ โธปกรณ์นÊัน มีวิธีการทีÉจะดาํ เนินการ
หลายวิธีเช่นกนั ซÉึงในขัÊนตอนการจดั หาอาวุธยทุ โธปกรณ์ทางการทหาร มีการทาํ สัญญาประเภทต่าง
ๆ ซึÉงอาจเป็นสัญญาระหว่างรัฐต่อรัฐ หรือสัญญาซืÊอขายระหว่างประเทศ หรือสัญญาทีÉกระทาํ ต่อ
ตวัแทนคา้อาวุธในต่างประเทศทีÉตัÊงอยูใ่ นประเทศ ซÉึงในการบริหารสัญญาจดั หาอาวุธยทุ โธปกรณ์
ดงักล่าว บางครÊังพบขอ้ พิพาททีÉเกิดขÊึน เนืÉองจากการไม่ปฏิบตัิตามขอ้ สัญญาความล่าชา้ในการปฏิบตัิ
ตามสัญญา การตีความ หรือจากเหตุสุดวิสัยต่างๆ ทีÉเกิดขÊึนภายหลงัการทาํ สัญญาและส่งผลต่อการ
ปฏิบตัิตามสัญญา จนอาจนาํไปสู่การตกลงแกไ้ขเพิÉมเติมสัญญา และการปฏิบตัิผิดสัญญาการปรับ
หรือเรียกค่าเสียหายจากการผิดสัญญา
ผลการวิจยั พบประเด็นปัญหาสําคญั ทีÉเกิดขÊึน ในการจดั หาอาวุธยทุ โธปกรณ์ทาง
การทหารหลายประการ และการกาํหนดแนวทางเงืÉอนไขของสัญญา ทีÉจะไม่ทาํให้กองทพั เสียเปรียบ
ซึÉงผลการวิจยัในครÊังนีÊไดข้อ้เสนอแนะว่ากองทพั ตอ้งตระหนักในภารกิจของสํานกังานอยัการสูงสุด
ซึÉงมีหน้าทีÉในการตรวจร่างสัญญา กองทพัควรเพิÉมพูนความรู้และทกั ษะ ให้แก่บุคลากรทีÉมีส่วนร่วม
ในการยกร่างสัญญาจดั หาอาวุธยทุ โธปกรณ์ทางการทหาร คณะรัฐมนตรีควรมีมติกําหนดให้
หน่วยงานรัฐทีÉส่งร่างสัญญาไปให้สํานักงานอยัการสูงสุดตรวจ ตอ้งปฏิบตัิตามทีÉสํานักงานอยัการ
สูงสุดตรวจร่างสัญญาและมีขอ้ สังเกต คณะรักษาความสงบแห่งชาติและสํานักงานอยัการสูงสุดควร
พิจารณาร่วมกนั จดั ทาํระเบียบเกีÉยวกบัการจดั หาอาวุธยุทโธปกรณ์ทางการทหารแบบรัฐต่อรัฐ เพÉือเป็ น
กรอบให้หน่วยงานทีÉเกีÉยวขอ้ง ยดึถือเป็นแนวทางปฏิบตัิในการดาํ เนินการจดั หาอาวุธยทุ โธปกรณ์เพืÉอ
ความโปร่งใส อนัจะนาํไปสู่การรักษาผลประโยชน์ของกองทพั และประเทศชาติต่อไป

ABSTRACT
Title Contract for Armament Procurement r elated to National Security

To procure the armaments for the use by the Army, there were regulations and
governmental related practices including conditions to be concerned. There for, the procuring
units must strictly comply with such regulations and practices. Furthermore, there are various
methods to procure the armaments and also various contracts, which are the Government to
Government contract, the International contract or the contract made with the oversea agent
locating inside as the country. During the armament contract management period, the disputes
are always found as a result of the non-compliance with the contract, the delay to performance
under the contract, the interpretation of the contract or force majeure which occurs after the
contract was signed. These affect the performance of the contract and lead to the amendment of
the contract, the non compliance of the contract, and the claim for penalty and damages.
Research has found many major problems arisen from the procurement of the
armament and guidelines for the conditions of the contract which will not lessen the advantages
of the Army. This research suggests that the Army must take into account of the fask of the
Office of the Attorney General which is the duty to revise the contract. The Army must enhance
the skill and knowledge of the staffs who are assigned to have the duty to initially draft the
contract and submit it to the Office of the Attorney General for review and also must comply to
the revised contract and the remarks given by the Office of the Attorney General. National
Council for Peace and Order and the Office of the Attorney General are advised to Jointly
create the Rules relating to the government to government procurement of the armament as a
guideline for the related units to comply with for the purpose of transparency and the protection
of the advantages of the Army and the Nation
