เรื่อง แนวทางการแก้ไขปัญหาชาวโรฮิงญาลักลอบเข้าเมืองโดยผิดกฎหมายของหน่วยงาน

การศึกษาครั้งนี้มีวัตถุประสงค์เพื่อศึกษาสภาพปัญหาและอุปสรรคในการแก้ไขปัญหาชาว
โรฮิงญาลักลอบเข้าเมืองโดยผิดกฎหมายและเพื่อก าหนดแนวทางการแก้ไขปัญหาชาวโรฮิงญาลักลอบเข้า
เมืองโดยผิดกฏหมายของหน่วยงานภาครัฐแบบบูรณาการ การศึกษารวบรวมข้อมูลโดยการสัมภาษณ์เชิง
ลึกเจ้าหน้าที่ภาครัฐสังกัดหน่วยงานที่เกี่ยวข้อง และการตรวจเอกสาร เพื่อน ามาก าหนดแนวทาง การ
แก้ไขปัญหาชาวโรฮิงญาลักลอบเข้าเมืองโดยผิดกฎหมาของหน่วยงานภาครัฐแบบบูรณาการต่อไป ผล
การศึกษาปัญหาและอุปสรรคในการแก้ไขปัญหาชาวโรฮิงญาลักลอบเข้าเมืองโดยผิดกฎหมาย มีดังนี้1.
ปัญหาภายในหน่วยงาน 1.1อัตราก าลังเจ้าหน้าที่ งบประมาณ ครุภัณฑ์ไม่เพียงพอ 1.2 พื้นที่รับผิดชอบมี
อาณาเขตกว้างขวาง 1.3 การด าเนินคดีกับผู้กระท าผิดต้องประสานงานกับหน่วยงานอื่น 1.4 สถานที่
ควบคุมตัวไม่เพียงพอ 1.5 ประเทศเมียนมาร์ไม่ยอมรับชาวโรฮิงญากลับประเทศ และ 1.6 กอ.รมน.จังหวัด
ไม่มีอ านาจสั่งการบางหน่วยงานตาม พ.ร.บ. รักษาความมั่นคงภายในราชอาณาจักร พ.ศ. 2551 2. ปัญหา
ระหว่างหน่วยงาน 2.1ขาดบุคคลากรที่สื่อสารกับชาวโรฮิงญาได้อย่างถูกต้อง 2.2 ขาดการประสานการ
ปฏิบัติระหว่างหน่วยงานแบบบูรณาการ 2.3 ไม่มีหน่วยงานหลักรับผิดชอบการแก้ไขปัญหา 2.4 หน่วยงาน
ที่เกี่ยวข้องไม่ทราบขอบเขตความรับผิดชอบ แนวทางและขั้นตอนการปฏิบัติตามหลักสากล 2.5 หน่วยงาน
ขาดการบังคับใช้กฎหมายแบบบูรณาการ ส่วนแนวทางการแก้ไขปัญหาชาวโรฮิงญาลักลอบเข้าเมืองโดย
ผิดกฏหมายของหน่วยงานภาครัฐแบบบูรณาการ มีดังนี้1. ระดับปฏิบัติการ 1.1 ก าหนดสถานที่ควบคุมตัว
ให้เพียงพอ1.2 จัดเจ้าหน้าที่สื่อสารกับผู้กระท าผิดได้อย่างถูกต้อง 1.3 ปฏิบัติต่อผู้กระท าผิดตามหลักสากล
และหลักสิทธิมนุษยชน 1.4ก าหนดหน่วยงานหลักประสานการปฏิบัติ/การบังคับบัญชา 1.5 จัดท าแผน
ปฏิบัติการร่วมแบบบูรณาการ 1.6ก าหนดขอบเขตรับผิดชอบด้านอ านาจหน้าที่ แนวทางและขั้นตอนการ
ปฏิบัติตามหลักสากล1.7จัดชุดลาดตระเวนร่วมในพื้นที่ล่อแหลมอย่างต่อเนื่อง 1.8 ปฏิบัติการด้านการข่าว
แบบบูรณาการ1.9จัดก าลังเจ้าหน้าที่ งบประมาณ วัสดุครุภัณฑ์ให้เพียงพอ1.10สร้างเครือข่ายด้านการข่าว
ภาคประชาชนและทุกภาคส่วน 1.11จัดอบรมเจ้าหน้าที่ด้านกฎหมายและหลักการปฏิบัติที่เกี่ยวข้อง 1.12
น าเสนอปัญหาและอุปสรรคการแก้ไขปัญหาชาวโรฮิงญาฯ ต่อผู้บังคับบัญชาตามล าดับชั้น 2. ระดับนโยบาย 2.1
สตช. และ กอ.รมน. จัดท านโยบาย/แผนงานของหน่วยงานระดับปฏิบัติการแบบบูรณาการ จัดก าลัง
เจ้าหน้าที่ งบประมาณ วัสดุ ครุภัณฑ์ให้ทุกหน่วยงานอย่างเพียงพอ และน าปัญหาและอุปสรรคการแก้ไข
ปัญหาของหน่วยงานระดับปฏิบัติมาใช้ประกอบการก าหนดแนวทางระดับนโยบาย และ 2.2 รัฐบาลไทย
ควรประสานโดยตรงกับประเทศเมียนมาร์ หรือสั่งการคณะกรรมการชายแดนส่วนท้องถิ่นไทย – เมียนมาร์
จังหวัดระนอง (TBC) เพื่อเจรจาหาแนวทางการแก้ไขปัญหาชาวโรฮิงญาลักลอบเข้าเมืองโดยผิดกฎหมาย
ร่วมกันอย่างเป็นรูปธรรม

The objectives of this study were to studied problem and difficulty to solve the
problem about rohingya smuggle entry illegally, and to determine the rohingya smuggle entry
illegally integrated resolution guideline of state agency. The studied was gathered data by in-depth
interview the officers of related state agency and document research in oder to determine the
rohingya smuggle entry illegally integrated resolution guideline of state agency. The results of the
studied problem and difficulty to solve the problem about rohingya smuggle entry illegally were 1.
problem inside agency 1.1 state officers, budget and durable articles not enouth 1.2 burder
responsibility area was spacious 1.3 offender legal proceedings need to coordinate with another
state agency 1.4 prison not enouth 1.5 Myanmar was refuse rohingya return country 1.6 The province
internal security operations command not power commanding some stateagency onthe internal security act
of the Kingdom 2551 BE. 2. problem between agency 2.1 lake of the personnel communicate with

the major state agency to solve the problem 2.4 the related state agency didn’t know scope of

Operations Command should assign integrated operating policy/planning, enouth state officers,
budget and durable articles and apply the problem and difficulty to solve the problem about
rohingya smuggle entry illegally to assign policy guideline 2.2 Thai government direct coordinating
activities with Myanmar or command the township border committee (TBC: between Thailand and
Myanmar, Ranong province) in order to co-negotiate the guideline to solve the problem about
rohingya smuggle entry illegally with tangibly.
