In the past few decades there has been a revolution in information
technology very rapidly. There is a trend that the technology will be developed more.
This has been making the communication, which is the people's basic right in present
time, easy, expeditious, economical, and extensive coverage all over the world. At the
same time, it has been utilized in negative ways and had an adverse impact on national
security. For examples, sending false information to cause the hatred among people,
improperly use personal data and hacking into the state's server.
The use of information technology for communication may be examined by
the state in order to maintain national security. However, this kind of control should be
right, proper and fair. This research paper has focused on the balance between the right
to communication and national security by the court of justice. The court of justice
should be the one who controls and examine the process of the officials to investigate
and collect personal information and privacy.
