ส าหรับการศึกษาวิจัยเรื่อง บทบาทกองทัพเรือรองรับร่าง พ.ร.บ.การรักษาผลประโยชน์
แห่งชาติทางทะเล พ.ศ….. นั้น มีวัตถุประสงค์เพื่อศึกษาหลักการ ทฤษฎี ตลอดจนการวิเคราะห์ ร่าง
พ.ร.บ. การรักษาผลประโยชน์ของชาติทางทะเล พ.ศ..... รวมทั้งการศึกษาและวิเคราะห์บทบาทของ
กองทัพเรือในการรักษาผลประโยชน์ของชาติทางทะเล ตาม พ.ร.บ.การรักษาผลประโยชน์ของชาติ
ทางทะเล พ.ศ..... และการบูรณาการความร่วมมือ ตลอดจนสนธิขีดความสามารถร่วมกับหน่วยงาน
ต่างๆ ทุกภาคส่วนที่เกี่ยวข้องกับการรักษาผลประโยชน์ของชาติทางทะเล โดยมีขอบเขตของการวิจัย
เน้นการวิจัยเฉพาะโครงสร้างทางกองทัพเรือที่มีอยู่ในปัจจุบัน โดยไม่มีการปรับปรุงโครงสร้างใหม่
ตลอดจนการปรับปรุงบทบาทและโครงสร้าง แนวคิดการใช้ก าลังของ ศรชล. ในการปฏิบัติการเพื่อ
รองรับภัยคุกคามรูปแบบใหม่ ได้อย่างเหมาะสมเป็นรูปธรรม ทั้งนี้ได้เน้นการวิจัยเฉพาะนโยบายที่
เปิดเผยได้เท่านั้น ซึ่งวิธีด าเนินการวิจัย เป็นการวิจัยเชิงคุณภาพและเชิงพรรณนา และศึกษาวิเคราะห์
โดยรวบรวมข้อมูลจากต ารา เอกสารทางราชการ พระราชบัญญัติต่างๆ ในส่วนที่เกี่ยวข้อง คู่มือและ
หลักปฏิบัติของ หน่วยงานต่างๆ ที่เกี่ยวข้อง สถานการณ์โลก ภูมิภาค และภายในประเทศ สภาพ
ภูมิศาสตร์ และพื้นที่ปฏิบัติการ รวมทั้งการสัมภาษณ์ผู้ทรงคุณวุฒิ และผู้ที่มีประสบการณ์การท างาน
ในส่วนที่เกี่ยวข้อง แล้วน าไปเปรียบเทียบกับหลักการและเหตุผลตลอดจนวิเคราะห์ข้อมูลเพื่อน าไปสู่
ผลการวิจัย และข้อยุติ ตลอดจนข้อคิดเห็นและข้อเสนอแนะที่ประโยชน์ต่อไป ทั้งนี้จากผลการวิจัย
สามารถตอบวัตถุประสงค์ของการวิจัยทั้ง 3 ประเด็น โดยในภาพรวมนั้น การด าเนินงานในด้านความ
มั่นคงทางทะเลจะเกิดการเปลี่ยนแปลงแนวทางการปฏิบัติในรูปแบบใหม่ ทั้งนี้เนื่องจากโครงสร้างตาม
ร่าง พ.ร.บ.การรักษาผลประโยชน์แห่งชาติทางทะเลฉบับใหม่ จะมีการเปลี่ยนแปลงและมีรายละเอียด
ในระดับนโยบาย และระดับการปฏิบัติ ที่มีอ านาจในการบริหารจัดการมากยิ่งขึ้น ซึ่งกองทัพเรือจะ
เป็นหน่วยงานหลักที่จะต้องมีส่วนร่วมทั้งในระดับนโยบาย และระดับปฏิบัติการ ดังนั้นกองทัพเรือจึงมี
ความจ าเป็นที่จะต้องก าหนดบทบาทส าคัญในการจัดเตรียมแนวทางในการปฏิบัติงานเพื่อรองรับการ
ท างานของ ศรชล.ใหม่ ให้มีศักยภาพ สามารถตอบสนองต่อการรักษาผลประโยชน์แห่งชาติทางทะเล
ได้อย่างมีประสิทธิภาพ ซึ่งการด าเนินงานของ ศรชล.ใหม่นั้น กองทัพเรือจะมีบทบาทส าคัญในการ
ปฏิบัติภารกิจดูแลการรักษาผลประโยชน์แห่งชาติทางทะเล โดยมีทัพเรือภาคทั้ง ๓ พื้นที่ เป็น
หน่วยงานส าคัญในการดูแลงานในระดับปฏิบัติการ ซึ่งจะต้องอ านวยการ และดูแลงานรักษา
ผลประโยชน์แห่งชาติทางทะเลในพื้นที่รับผิดชอบร่วมกับหน่วยงานทางทะเลต่างๆ ตั้งแต่ในยามปกติ
ทั้งนี้กองทัพเรือจะต้องมีการเตรียมความพร้อมทั้งทางด้านองค์บุคคล องค์วัตถุ และองค์ยุทธวิธี
ที่เกี่ยวข้องกับงานด้านการรักษาผลประโยชน์แห่งชาติทางทะเล ให้มีความพร้อมที่จะรองรับต่อการ
เปลี่ยนแปลงที่จะเกิดขึ้นภายหลังจากที่ พ.ร.บ.การรักษาผลประโยชน์แห่งชาติทางทะเล ฉบับใหม่ที่จะข
บังคับใช้ในไม่ช้านี้โดยผลจากการวิจัยมีข้อเสนอแนะเชิงนโยบาย เกี่ยวกับการบูรณาการการใช้ก าลัง
จะต้องด าเนินการอย่างจริงจังและชัดเจนในทุกด้าน อาทิเช่น การพิจารณาแบ่งพื้นที่รับผิดชอบ
ระหว่าง กอ.รมน.และ ศรชล. การแบ่งมอบงานให้มีความชัดเจนและไม่เกิดการท างานซ้ าซ้อนของ
หน่วยงานทางทะเล ส่วนข้อเสนอแนะในการปฏิบัตินั้นเห็นว่า การจัดการโครงสร้างของ ศรชล. ใหม่
นั้น กองทัพเรือในฐานะหน่วยงานหลักที่ท าหน้าที่ในการอ านวยการงานด้านการรักษาผลประโยชน์
แห่งชาติทางทะเลในภาพรวม ทั้งในระดับนโยบาย และระดับปฏิบัติ จะต้องมีการเตรียมการรองรับ
เรื่องการจัดโครงสร้างทั้งด้านองค์บุคคล และองค์วัตถุ ให้สามารถรองรับการบูรณาการ
ขีดความสามารถของทุกภาคส่วนของหน่วยงานด้านความมั่นคงทางทะเลที่เกี่ยวข้อง เพื่อให้การรักษา
ผลประโยชน์ของชาติทางทะเลและความมั่นคงทางทะเลเกิดประสิทธิภาพสูงสุด นอกจากนี้กองทัพเรือ
จะต้องมีบทบาทน าในการผลักดันการจัดตั้งสถาบันกิจการทางทะเลในรูปแบบที่มีความเหมาะสม
เทียบเคียงกับของต่างประเทศ เพื่อให้เป็นส่วนหนึ่งของโครงสร้าง ศรชล.ในระดับนโยบาย ซึ่งอาจเป็น
ส่วนหนึ่งของส านักงานคณะกรรมการที่ปรึกษาและจัดการความรู้เพื่อผลประโยชน์ของชาติทางทะเล
(ทจชล.) ส าหรับสนับสนุนองค์ความรู้ในงานด้านความมั่นคงทางทะเลให้กับ ศรชล. ซึ่งองค์ความรู้
ดังกล่าวจะต้องมีความเชื่อมโยงกับศูนย์ศึกษาอบรม ที่จะท าหน้าที่ในการสนับสนุนองค์ความรู้ให้กับ
ศรชล.ภาคและ ศรชล.จังหวัด สามารถน าองค์ความรู้ดังกล่าวไปปฏิบัติงานในการรักษาผลประโยชน์
แห่งชาติทางทะเลได้อย่างมีประสิทธิภาพในอนาคตต่อไป รวมทั้งกองทัพเรือจะต้องมีบทบาทน าใน
การก าหนดแนวทางการปฏิบัติงานของหน่วยงานความมั่นคงทางทะเลที่ปฏิบัติงานร่วมกันใน ศรชล.
ให้สามารถบูรณาการการใช้ก าลังในระดับปฏิบัติการมีขีดความสามารถสูงสุด รวมทั้งการพิจารณาใช้
ก าลังตามแผนป้องกันประเทศ อาทิเช่น หน่วยบัญชาการต่อสู้อากาศยานและรักษาฝั่ง กองทัพเรือ
(สอ.รฝ.) มาเสริมการปฏิบัติงานของ ศรชล.ตั้งแต่ในภาวะปกติ ทั้งในเรื่องของการสนับสนุนก าลังพล
ด าเนินกิจตามที่ ศรชล.ภาค ร้องขอ และการเฝ้าตรวจการณ์ทางทะเลสนับสนุนข้อมูลให้กับ ศร.ชล.
เพื่อให้การปฏิบัติภารกิจการรักษาผลประโยชน์แห่งชาติทางทะเลของกองทัพเรือ เกิดประสิทธิภาพ
สูงสุด

The objective of this research on the Role of the Royal Thai Navy in
support of the Marine National Interests Preservation Act B.E….. is to study principles,
theories andconduct the analysis of the draft of the Marine National Interests
Preservation Act B.E.... as well as the analysis of the role of the Royal Thai Navy in
preserving the national marine interests under the Act, including the cooperation of
the integrated forces of the agencies of all sectors, the responsibilities of which
arerelated to the preservation of marine national interests.
The scope of this research is focused on the existing structure of the
Royal Thai Navy, the improvement of its roles and structure, as well as the concept
of Thailand-Maritime Enforcement Coordinating Center’sproper use of its forces to
launch counter-attacks against the new forms of threats for concrete results. With
emphasis given only on the open policy, this research is conducted as a qualitative
and descriptive research. The analysis of the research is conducted successfully,
based on the datacollected from texts, official documents, various relevant
statutes, manuals and codes of conduct of agencies, global, world situations, both
locally and internationally, geography and areas of operations including interviews
with experts and those who have extensive experience in the relevant fields, and
after which comparing them to the principles and rationale before making the
analysis for the conclusive results, comments and suggestions.
The results of the research can be summarized in three points as
follows: Marine security operations will change the way they have been
implemented in new ways, because of the draft structure the Marine National
Interests Preservation Act B.E.... with more details at the policy and the operation
levels with more management power. Since the Royal Thai Navy will serve as the
main agency involved both at the policy and operation levels, it is essential that
the Royal Thai Navy perform a key role in providing operational guidelines to
support the operation of the new Thailand-Maritime Enforcement Coordinating
Centerin order to effectively respond to the effective protection of national marine
interests. With the restructuring of Thailand-Maritime Enforcement Coordinating 2
Center, the Royal Thai Navy will therefore play an important role in the mission to
protect the national marine interests. The Third Naval Area Command then will
become an important unit at the operation level, in charge of directing
andsupervising the maintenance and protection of national marine interests in the
area of its responsibility, in conjunction with various maritime agencies from the
normal time. The Royal Thai Navy must get itself well-prepared for the readiness of
its personnel, materials, and tactics to support the protection of national marine
interests and also for all responses to any change that may take place immediately
following the coming into effect of the new Act.
The results of the research will provide recommendations and
suggestions on policy concerning the use of integrated forcesand their full
implementation in all respects, such as the allocation of the areas of responsibility
between the Internal Security Operations Command and Thailand-Maritime
Enforcement Coordinating Center, a clear cut assignment of tasks to all agencies
concerned to avoid redundancies, etc. As far as the operations of the restructured
Thailand-Maritime Enforcement Coordinating Center is concerned, the Royal Thai
Navy acting as the main agency at the policy and operation levels must get its man
power and materials ready to support all the marine agencies concerned in their
protection of the national marine interests and national security. In addition to that,
the Royal Thai Navy must also take a leading role in bringing about the
establishment of a new maritime unit, whose form of organization is comparable to
that of foreign countries, to be attached with Thailand-Maritime Enforcement
Coordinating Center at the policy level, to act as part of the office of advisory board
and as a disseminator of knowledge to the marine agencies concerned for their
benefit. The body of such knowledge will be linked into the training center which
provides knowledge to the regional and provincial units representing ThailandMaritime Enforcement Coordinating Center. They can make use of this knowledge
for their work to protect the national maritime interests. However, the Royal Thai
Navy will have to play a leading role in defining the operational guidelines of the
marine agencies working together at Thailand-Maritime Enforcement Coordinating
Center for the optimal use of the integrated forces at the operational level
including taking into consideration the use of forces according to the National
Defence Plan. For instance, the Air and Coastal Defence Command will reinforce the
work of Thailand-Maritime Enforcement Coordinating Centerfrom the normal time
upon its request and monitor maritime situations with their report to supportthe 3
operation of Thailand-Maritime Enforcement Coordinating Centerto protect the
national marine interests.
