เรื่อง แรงงานตางดาวกับความมั่นคงของชาติ

สืบเนื่องมาจากการทํารัฐประหารของคณะรักษาความสงบแหงชาติ (คสช.) เมื่อวันที่ 22
พฤษภาคม 2557 ไดมีการออกคําสั่งเกี่ยวกับแรงงานตางดาว ในคําสั่งที่ 59/2557 ลงวันที่ 10
มิถุนายน 2557เรื่องแตงตั้งคณะกรรมการนโยบายการจัดการปญหาแรงงานตางดาว แรงงานตางดาว
ในประเทศไทย เหตุการณดังกลาวไดกอใหเกิดผลกระทบกับบรรดานายจางในกลุมธุรกิจตาง ๆ
คือการขาดแคลนแรงงาน โดยเฉพาะแรงงานในภาคอุตสาหกรรมการกอสราง ภาคอุตสาหกรรม
ประมง และภาคการเกษตร ประเทศไทยจึงมีความจําเปนอยางยิ่งในการเรงแกไขปญหาแรงงานตาว
ดาวผิดกฎหมายใหถูกตองตามกฎหมาย เพื่อรักษากลไกการขับเคลื่อนระบบเศรษฐกิจใหมีเสถียรภาพ
ยิ่ง ๆ ขึ้นไป ดังนั้น ผูวิจัยจึงมีแนวความคิดที่จะทําการศึกษาวิจัย การจัดการแรงงานตางดาวที่ผิด
กฎหมาย โดยผูวิจัยจะทําการศึกษามาตรการสกัดกั้นแรงงานตางดาวลักลอบเขามาโดยผิดกฎหมาย
ดวยการศกึษาวิจัยเพื่อสืบคน อุปสรรค และสาเหตุ จากหนวยงานที่เกี่ยวของ รวมถึงมาตรการสกัดกั้น
และกวาดลางแรงงานตางดาวผิดกฎหมาย มาตรการที่กลาวมาขางตนมีประสิทธิภาพและประสิทธิผล
แลวหรือไม
การวิจัยนี้มีวัตถุประสงคเพื่อศึกษาหลักทฤษฎีและแนวคิดที่เกี่ยวของกับแรงงานตางดาว
ศึกษาสถานการณแรงงานตางดาว 3 สัญชาติ (เมียนมา ลาว กัมพูชา) ในประเทศไทย ศึกษาและ
วิเคราะหแนวนโยบายการจัดการแรงงานตางดาวของคณะกรรมการนโยบายการจัดการปญหา
แรงงานตางดาวและการคามนุษย (กนร.) ตามคําสั่งคณะรักษาความสงบแหงชาติที่ 73/2557
ลงวันที่ 25 มิถุนายน 2557และตามคําสั่งคณะรักษาความสงบแหงชาติที่ 74/2557 ลงวันที่ 25
มิถุนายน 2557 ในการแกไขปญหาแรงงานตางดาวทั้งระบบ และเพื่อทราบถึงปญหาอุปสรรค
ขอขัดของ และเสนอแนะแนวทางการบริหารจัดการและแกไขปญหาแรงงานตางดาว 3 สัญชาติ ใน
ประเทศไทยอยางเปนระบบ รวมทั้งมาตรการควบคุม การสกัดกั้นและกวาดลางแรงงานตางดาวอยาง
มีประสิทธิภาพเพื่อความมั่นคงของประเทศ
ผลการศึกษาพบวา ปญหาแรงงานตางดาวกับความมั่นคงของชาติ เปนสิ่งที่ประชาชน
ทุกคนในชาติจะตองรวมกันเขามามีสวนรวมในการแกไขปญหาอยางจริงจัง นายจาง/ผูประกอบการ
ถือเปนหัวใจสําคัญที่จะแกไขปญหานี้ โดยจะตองมีความรับผิดชอบ และมีสํานึกในหนาที่ของตนอยาง ข
เครงครัด ประชาชนทั่วไปตองใหความรวมมือ สอดสองดูแล เปนหูเปนตาใหกับเจาหนาที่ หนวยงาน
ของรัฐและเจาพนักงานจะตองปฏิบัติหนาที่ดวยความซื่อสัตยสุจริต มีการบูรณาการรวมกันเพื่อแกไข
ปญหาใหลุลวงอยางมีประสิทธิภาพ รัฐจะตองมีแนวนโยบายที่ชัดเจน ตอเนื่อง และจริงจัง ในการ
แกปญหา เพื่อที่จะใหแรงงานตางดาวสามารถเขามาอยูรวมกับสังคมไทยอยางปกติสุข เพื่อชวยพัฒนา
ประเทศใหเจริญกาวหนา โดยไมกระทบตอความมั่นคงของชาติ

Due to the coup of the National Council for Peace and Order (NCPO) on
22th May 2014 has issued an order regarding migrant workers in the order No.59/2557
on 10th June 2014 to up a committee entitled Policy Committee on managing the
problem of foreign workers in Thailand. This causes an impact on all employers in
the various business segments that is the shortage of labour, especially in the
construction, fishery and agricultural sectors. Thailand has a critical need in solving
the illegal migrant workers problem to be legal migrant workers to maintain the
stability of economic mechanism. Therefore the researcher has studied the illegal
migrant workers management by studying the measures to prevent illegal work
forces from entering into the country. This is to search for the obstacles and causes
from related departments as well as the measures to prevent and sweep illegal work
forces whether the measures mentioned above are effective or not.
This research aims to study the theories and concepts related to migrant
workers, study the situations of 3 nationalities migrant workers (Myanmar, Laos and
Cambodian) in Thailand, study and analyze the policy on migrant worker
management of the policy committee on migrant workers and human trafficking
according to an order No. 73/2557 of the National Council for Peace and Order on
25th June 2014 to solve the migrant workers problems in overall aspects and to
identify obstacles, difficulties and to propose the guidelines management practices
and systematic problems solving of 3 nationalities migrant workers in Thailand. As
well as the effective measures to control, prevent and sweep the illegal migrant
workers for the national security.
The results shows that the problems of migrant workers and national
security are what all citizens need to participate to resolve this issue seriously. The
employer/entrepreneur is the key to resolve this problem. They have to be
accountability and strictly realize of their duties. The public need to cooperate in
monitoring and look after things for the officers. Government agencies and officials
must perform their duties with honesty and integrated together to solve problems
effectively. The state must have a clear, continuous and serious policy in problem
solving in order to allow migrant workers to live together with Thai people
peacefully. This is in order to progressive develop our country without y negative
impact on national security.
