เรื่อง การด าเนินการของกระทรวงกลาโหมเพื่อให้ศูนย์แพทย์ทหารอาเซียน
ได้รับสถานะทางกฎหมายเอกสิทธิ์และความคุ้มกันส าหรับองค์การ
ระหว่างประเทศจากประเทศไทย

การศึกษาวิจัยในครั้งนี้เป็นการศึกษากระบวนการในการได้รับสถานะทางกฎหมายเอกสิทธิ์
และความคุ้มกันส าหรับองค์การระหว่างประเทศ จากประเทศเจ้าบ้านขององค์การระหว่างประเทศ
ของ ASEAN และองค์กรของอาเซียน มีที่ตั้งอยู่ราชอาณาจักรไทย โดยเฉพาะขั้นตอนการด าเนินการ
ตามกฎหมายไทย เพื่อให้ ACMM ได้รับสถานะทางกฎหมายเอกสิทธิ์และความคุ้มกันส าหรับองค์การ
ระหว่างประเทศจากประเทศไทย การวิจัยนี้เป็นการวิจัยเชิงคุณภาพ โดยด าเนินการวิจัยเชิงพรรณนา
และศึกษาหลักการและเหตุผลวิเคราะห์เชิงเปรียบเทียบ การด าเนินการของ ACMM จะต้องเริ่มจาก
จดทะเบียนเป็นมูลนิธิ และเริ่มจัดท าร่างเอกสารความตกลงการจัดตั้ง ACMM ใหม่ ที่ท้ายของเอกสาร
จะต้องมีการลงนามโดยผู้แทนประเทศสมาชิกอาเซียน ทั้ง ๑๐ ประเทศ โดยเมื่อได้รับอนุมัติและมีการลงนาม
จากการประชุมรัฐมนตรีกลาโหมอาเซียน หรือ ADMM แล้ว จะต้องจัดท าความตกลงกับประเทศเจ้าบ้าน
หรือ(Host Country Agreement: HCA) เช่นเดียวกับส านักงานเลขาธิการอาเซียน (ASEAN Secretariat)
ท ากับรัฐบาลอินโดนีเซีย และเสนอกระทรวงการต่างประเทศน าเข้าคณะรัฐมนตรีให้ความเห็นชอบ
อย่างไรก็ตามต้องอยู่ภายใต้พระราชบัญญัติเอกสิทธิ์และความคุ้มกันส าหรับองค์การระหว่างประเทศ
และการประชุมระหว่างประเทศในประเทศไทย พ.ศ.๒๕๖๑ ถ้าไม่ส าเร็จจะต้องด าเนินการในลักษณะเดียวกับ
พระราชบัญญัติของส านักงานเลขานุการข้าวฉุกเฉินของอาเซียนบวกสาม และกระทรวงกลาโหม ในฐานะ
ผู้ก่อตั้งและผู้สนับสนุนหลักของ ACMM ควรให้ความส าคัญในการด าเนินการสร้าง ACMM ให้มีความเข้มแข็ง
มีเจ้าหน้าที่ของประเทศสมาชิกต่าง ๆ เข้ามาร่วมกันท างาน รวมทั้งการขอรับการสนับสนุนในด้านต่าง ๆ
ซึ่งหมายรวมถึงเงินสนับสนุนองค์กร ทั้งนี้ การด าเนินการศึกษาวิจัยในครั้งต่อไปควรขยายการวิจัย
ในเชิงคุณภาพเกี่ยวกับการด าเนินการในรายละเอียดเกี่ยวกับแนวทางในการพัฒนาและปรับปรุง ACMM
ภายหลังได้รับสานะทางกฎหมายเอกสิทธิ์และความคุ้มกันจากประเทศไทย รวมทั้งบทบาทและความสัมพันธ์
ของประเทศไทยและกระทรวงกลาโหมในการสนับสนุนและใช้ประโยชน์จาก ACMMข
abstract:
Title Actions by the Ministry of Defence of Thailand for the ASEAN Center
of Military Medicine (ACMM) to obtain legal status, priviledges
and immunities for the international organization from Thailand.

This research is a study of the process of obtaining the legal status,
priviledges and immunities for the international organization from the host country of
the international organization of ASEAN and the organization of ASEAN located in the
Kingdom of Thailand especially the steps taken under Thai laws to allow the ACMM
to obtain the legal status, privileges and immunities for international organization
from Thailand. This research is descriptive research which studied principles as well
as analyzed reasons in comparison with the relate Agencies. The ACMM must start
from registering as a foundation and start drafting a document for establishment of ACMM
which is at the end of the document must haveThe signing of the representatives from all
10 ASEAN Member States. Once the document for establishment of ACMM is approved
and signed by The ASEAN Defence Ministers’ Meeting (ADMM). Another agreement
(Host Country Agreement (HCA)) must be consequently made by the ACMM with Thailand
as the ASEAN Secretariat did with the Government of Indonesia. The establishment of ACMM
agreement and HCA will be proposed to the Ministry of Foreign Affairs to bring the cabinet
for approval however it must be within the Immunities Act for International Organizations
and international conferences in Thailand 2018. In case of this process is unsuccessful.
It must be proceeded in theother way which is thesame manner as The Act of ASEAN Plus
Three Emergency Rice Reserve (APTERR). The ACMM should focus on strengthening
the ACMM capabilities therefore there will have officers of various member countries
joining together to work, including the support in various fields as well as the budget
contribution. The next descriptive research studies should expand in details on ways
to improve the ACMM after obtaining the legal status, priviledges and immunities from Thailand
and the roles and relations between The Ministry of Defence of Thailand and ACMM.ค
