บทคัดย่อ:
เรื่อง แนวทางการแก้ไขปัญหาการบุกรุกพื้นที่ป่าสงวนแห่งชาติ ป่าแม่ริม บริเวณพื้นที่
ดอยม่อนแจ่ม ตำบลแม่แรม อำเภอแม่ริม จังหวัดเชียงใหม่

การวิจัยนี้มีวัตถุประสงค์เพื่อศึกษาสภาพปัญหาการบุกรุกพื้นที่ป่า ปัญหา อุปสรรคของ
หน่วยงานภาครัฐในการแก้ไขปัญหาการบุกรุกพื้นที่ป่า แนวคิด ทฤษฎีการจัดการเพื่อแก้ไขปัญหาการบุกรุก
พื้นที่ป่า และเพื่อศึกษาแนวทางการแก้ไขปัญหาการบุกรุกพื้นที่ป่าสงวนแห่งชาติ ป่าแม่ริม บริเวณพื้นที่
ดอยม่อนแจ่มแบบบูรณาการข้อมูลการวิจัยรวบรวมโดยการสัมภาษณ์เชิงลึกผู้บริหารหรือผู้แทนหน่วยงานรัฐ
และการทบทวนวรรณกรรมที่เกี่ยวข้อง ผลการวิจัย พบว่า (1) สภาพปัญหาการบุกรุกพื้นที่ป่า1) การส่งเสริม
ให้เกษตรกรปลูกพืชผักผลไม้เมืองหนาว ทำให้มีแหล่งท่องเที่ยวเพิ่มขึ้น 2) ราษฎรบางส่วนเปลี่ยนอาชีพ
จากเกษตรกรรมมาทำธุรกิจท่องเที่ยว 3) ราษฎรบางส่วนขายสิทธิในที่ดินให้กับผู้ประกอบธุรกิจท่องเที่ยว
และ 4) การเติบโตของธุรกิจท่องเที่ยวทำให้เกิดการบุกรุกพื้นที่ป่าเพิ่ม (2) ปัญหาและอุปสรรคของ
หน่วยงานภาครัฐในการแก้ไขปัญหาการบุกรุกพื้นที่ป่า 1) การแก้ไขปัญหาขาดการประสานงานร่วมกัน
แบบบูรณาการ 2) ราษฎรส่วนใหญ่ขาดความรู้ความเข้าใจในสิทธิการครอบครองที่ดินตามกฎหมาย
3) เจ้าหน้าที่รัฐไม่ดำเนินการตามกฎหมายกับผู้กระทำความผิดอย่างจริงจัง 4) หน่วยงานรัฐบางหน่วยงาน
ไม่มีอำนาจหน้าที่ตามกฎหมาย 5) ราษฎรบางส่วนเปลี่ยนอาชีพจากเกษตรกรรมมาทำธุรกิจการท่องเที่ยว
และ 6) ราษฎรบางส่วนขายสิทธิในที่ดินให้กับผู้ประกอบธุรกิจท่องเที่ยว (3) แนวคิดและทฤษฎีการจัดการ
เพื่อแก้ไขปัญหาการบุกรุกพื้นที่ป่า1) พระราชบัญญัติป่าไม้ พุทธศักราช 2484 มาตรา 54 พระราชบัญญัติ
ป่าสงวนแห่งชาติ พ.ศ. 2507 มาตรา 14 และมติคณะรัฐมนตรีวันที่ 30 มิถุนายน พ.ศ. 2541
2) มติคณะกรรมการนโยบายที่ดินแห่งชาติ(คทช.) 3) แนวคิดการจัดการทรัพยากรป่าไม้อย่างยั่งยืน และ
4)จัดสรรปัจจัยทางการบริหาร (4M’s) อย่างเพียงพอ (4) แนวทางการแก้ไขปัญหาการบุกรุกพื้นที่ป่า
1) กรมป่าไม้ประสานการปฏิบัติกับทุกภาคส่วนแบบบูรณาการ และจัดสรรเงินงบประมาณอย่างเพียงพอ
2) ตรวจสอบสิทธิการถือครองที่ดินของราษฎรให้แล้วเสร็จ 3) บังคับใช้กฎหมายกับผู้กระทำผิดอย่าง
เฉียบขาดและ 4) จัดทำแผนแม่บทการบริหารจัดการพื้นที่ดอยม่อนแจ่มแบบบูรณาการ ภายใต้การแต่งตั้ง
คณะกรรมการจากทุกภาคส่วน เพื่อร่วมกันแก้ไขปัญหาการบุกรุกพื้นที่ป่าได้อย่างมีประสิทธิภาพต่อไป

Title Guidelines for Solving the Encroachment Problems in Mae Rim

The objectives of this research were to study forest encroachment problems,
problems and obstacles of government agencies in solving forest encroachment problems,
concepts and management theories to solve forest encroachment problems, and to study
an integrated solution solving problems of encroachment in Pa Mae Rim national forest
reserve at Doi Mon Jam area. Data of the research collecting by in-depth interviews
with executives or representatives of government agencies and review relevant literature.
The research found that (1) the forest encroachment problems in the study area
1) encouraging farmers to grow winter vegetables and fruits causing more tourist attractions
2) some of people changed their occupations from agriculture to tourism business 3) some
of people sold land rights to tourism business entrepreneur and 4) the growth of tourism
has resulted in increased encroachment of forest areas (2) problems and obstacles of
government agencies in solving forest encroachment 1) solving the problem was lack
of integrated coordination 2) most of people don’t have knowledge and understanding
of the right to possess land under the law 3) government officials don’t take legal action
against perpetrators seriously 4) some government agencies don’t have legal authority
5) some of people changed their occupations from agriculture to tourism business, and
6) some of people sold land rights to tourism business entrepreneur (3) management
concepts and theories to solve forest encroachment problems 1) Forest Act B.E. 2484,
Section 54, National Reserved Forest Act, B.E. 2507, Section 14 and Cabinet Resolutions
on 30th June, 1998, 2) the National Land Policy Committee Resolution (NTC) 3) forest
resource sustainable management concept and 4) allocate adequate management
factors (4M’s) (4) Guidelines for solving forest encroachment problems 1) The Royal
Forest Department coordinates operations with all sectors in an integrated way and
allocate sufficient budget 2) checking the rights land ownership of the people to complete
3) strictly enforce the law against offenders and 4) prepare integrated management
master plan of Doi Mon Jam area under the appointment of committees from all sectors
to solve the forest encroachment problems together with effectively.ค
