เอกสารวิจัยส่วนบุคคล เรื่อง แนวทางการด าเนินการของ ศรชล.ในการขับเคลื่อนการ
แก้ไขปัญหาท าประมงผิดกฎหมายของประเทศไทยอย่างยั่งยืน มีวัตถุประสงค์1. เพื่อวิเคราะห์ ปัญหา
อุปสรรค ข้อขัดข้อง ในการปฏิบัติงานของ ศรชล. กับหน่วยงานต่างๆ ที่เกี่ยวข้อง 2. เพื่อศึกษา กฎเกณฑ์
มาตรการ การด าเนินการท าการประมงอย่างยั่งยืนและมีความรับผิดชอบต่อส่วนรวม ตามที่องค์กร
ระหว่างประเทศก าหนด รวมทั้งการแก้ไขปัญหาของประเทศต่าง ๆ และประยุกต์ใช้เป็นแนวทางการ
แก้ไขปัญหาการท าประมงผิดกฎหมายของประเทศไทย 3. เพื่อก าหนดแนวทางการพัฒนา ศรชล.
ให้สามารถสนับสนุนการแก้ไขปัญหาการท าการประมงผิดกฎหมาย โดยให้สอดคล้องกับกับการท า
ประมงที่มีมาตรฐานเพื่อผลประโยชน์ของชาติอย่างยั่งยืน ทั้งนี้ผู้วิจัยด าเนินการวิจัยเชิงพรรณนา
โดยการรวบรวมข้อมูลและสัมภาษณ์ผู้แทนหน่วยและภาคส่วนต่าง ๆ ที่เกี่ยวข้อง รวมทั้งศึกษาค้นคว้า
จากต าราเอกสาร ระเบียบ คู่มือ กฎเกณฑ์ขององค์กรระหว่างประเทศ และมาตรฐานการท าประมง
ของประเทศต่าง ๆ และงานวิจัยที่เกี่ยวข้อง ตลอดจนค้นหาข้อมูลทางอินเตอร์เน็ต แล้ววิเคราะห์
เปรียบเทียบ หลักการ เหตุผล กับการปฏิบัติงานตามความเป็นจริง เพื่อน าไปสู่ผลการวิจัย และข้อยุติ
เพื่อน าไปใช้ประโยชน์ในการก าหนดมาตรการให้มีการท าการประมง
ผลจากการวิจัย ท าให้ได้รับทราบบทเรียนของ ศรชล.ในการแก้ไขปัญหาการท า
ประมงที่ต้องการการบูรการหน่วยงานที่เกี่ยวข้องมาปฏิบัติงานร่วมกัน โดยการจัดโครงสร้างหน่วย
การจัดฝ่าย และส่วนงานต่าง ๆ รองรับงานที่จะต้องด าเนินการ เช่น งานด้านสื่อสารยุทธศาสตร์ งานการ
ประเมินผลการปฏิบัติงานหน่วยงาน เป็นต้น รวมทั้งงานการพัฒนาบุคลากรในกระบวนการบังคับ
ใช้กฎหมายให้มีมาตรฐานการด าเนินการที่เป็นหนึ่งเดียว การจัดการองค์ความรู้ด้านกิจการประมง
ให้ผู้ที่มาปฏิบัติงานร่วมกันให้ความรู้ในระดับที่ใกล้เคียงกัน เช่น การก าหนดนโยบายและจัดท า
แผนการประมงแห่งชาติ (FMP) การตรวจสอบย้อนกลับ (Traceability) การควบคุมการท าประมง
การตรวจสอบแรงงานประมงในทะเล เป็นต้น ข้อเสนอแนะในการท าวิจัยครั้งต่อไป มีดังนี้ 1. ศรชล.
ควรส่งเสริมให้มีการขยายผลการวิจัยงานบทบาทการบังคับใช้กฎหมาย เพื่อให้มีบทบาทน า
และช่วยสนับสนุนการรักษากฎหมายให้มีประสิทธิภาพต่อไป 2. ศรชล.ควรสนับสนุนให้มีการวิจัยลง
ไปในระดับ ศรชล. ภาคว่าจะสามารถน านโยบายและการบังคับใช้กฎหมายไปสู่การปฏิบัติให้เกิด
ประสิทธิภาพได้อย ่างไร ในขณะที ่เป็นหน ่วยปฏิบัติ แต ่ยังขาดเครื ่องมือ และก าลังพลที ่มี
ความเชี่ยวชาญด้านกฎหมายทางทะเลข

Title Guidelines for SORCHON's actions in driving sustainable solutions
against illegal fishing in Thailand

Personal Research Paper on SORCHON's Approach in Driving Sustainable
Solutions to control Thailand's Illegal Fishing Problem. Objective 1: To analyze
problems, challenges and gaps. Objective 2: To study and apply the rules, measures,
and sustainable fishing practices and collective responsibilities of the stakeholders as
specified by international organizations to solve the problem of illegal fishing in
Thailand. Objective 3. To set guidelines for developing and supporting the solution of
illegal fishing problems in accordance with fishing standards for the sustainable
national interest.
The research paper adopted a descriptive research approach by
gathering data and interviewing representatives from relevant units and sectors, as
well as conducting research from operating manuals. Regulations, manuals, rules of
international organizations, fisheries standards of different countries as well as related
resources and article from the internet were used for comparative analysis. Principles,
reasoning, and lessons from actual operations were analyzed leading to recommendations
and resolutions to be used in determining the suitable measures for illegal fishing.
As a result of the research, one of the key lessons learnt from solving the
problem of illegal fishing was the importance of relevant agencies to work closely
together. These included the structuring of units, departments, and divisions suitably
to support the tasks that need to be carried out (e.g., strategic communication).
A structured and unified standard of conduct on personnel development in law
enforcement processes is also required. Additionally, the proper knowledge
management in fisheries affairs is also important to ensure the support units have
similar level of knowledge and proficiency, such as policy formulation and preparation of
the National Fisheries Plan (FMP), traceability, fishery control, and inspection of sea
fishery workers, etc.
Building on the findings of this research, it is suggested that subsequent
research can look into: 1. How to promote and strengthen the capabilities on law
enforcement and the necessary preparation needed to play a more active role in
supporting law enforcement in a marine environment 2. How to encourage research
at the ARROW level to effectively implement policy and law enforcement due to the
lack of equipment and personnel specialized for maritime law enforcement. ค
