การวิจยันÊีมีวตัถุประสงคเพื ์ Éอศึกษาสถานการณ์ ผลกระทบของคนต่างชาติเขา้เมืองผิด
กฎหมายเพืÉอจดั ทาํยุทธศาสตร์และเสนอมาตรการ/แนวทางการแก้ไขปัญหาคนต่างชาติเข้าเมืองผิด
กฎหมายและจดั ทําข้อเสนอแนะแนวทางในการบริหารจดัการคนต่างชาติเข้าเมืองผิดกฎหมายทีÉมี
ประสิทธิภาพ โดยมีขอบเขตการวิจยัจาํกดัเฉพาะคนต่างชาติจากประเทศพม่าลาวและกมัพูชาเนืÉองจากมี
ชายแดนติดตอ่ กบั ประเทศไทยยาวมากจนสามารถลกัลอบผา่ นชายแดนไดอ้ยา่ งสะดวกวิธีดาํเนินการวจิยั
เป็นการศึกษาวิจยัเชิงคุณภาพ โดยรวบรวมขอ้ มูลจากเอกสารทางวิชาการทีÉเกีÉยวขอ้งกบัคนต่างชาติเขา้
เมืองผิดกฎหมายรวมทัÊงเก็บรวบรวมขอ้ มูลจากระบบฐานขอ้ มูลทีÉไดจ้ากแหล่งต่าง ๆ ผลการวิจยัพบว่า
กฎหมายต่าง ๆไม่มีความเหมาะสมทÉีจะนาํ มาใช้บริหารจดัการได้การเจรจานําเขา้ตามMOU และการ
พิสูจน์สัญชาติมีขัÊนตอนยุ่งยากและตน้ ทุนสูงขณะทีÉอตัราเจริญพนัธุ์ของคนไทยลดลงทาํให้โครงสร้าง
อายุไม่สมดุลแรงงานไทยไม่เพียงพอเป็นแรงดึงดูดคนต่างชาติเขา้เมืองผดิกฎหมายเขา้มาทาํงานสกปรก
เสีÉยงและยากลําบาก ส่วนแรงผลักดันในประเทศเพÉือนบ้านมีแนวโน้มทีÉจะมีผลลดลงเนืÉองจากการ
เจริญเติบโตทางเศรษฐกิจของลาวและกมั พูชารวมทÊงัการเปิดประเทศของพม่า นโยบายบริหารจดัการ
เรืÉองนีÊอาศยัมติคณะรัฐมนตรีในแต่ละปีทาํให้ขาดความสมดุลเพราะมติจะเปลีÉยนแปลงไปตามการ
ผลักดันของกลุ่มหน่วยงานทÉีเน้นความมัÉนคงหรือกลุ่มหน่วยงานทีÉเน้นด้านเศรษฐกิจขณะทÉีด้าน
สาธารณสุขและสิทธิมนุษยชนยงัไม่ได้รับการดูแลอย่างเพียงพอ ส่งผลกระทบให้เกิดปัญหาทÊงความ ั
มันÉ คงเศรษฐกิจ สาธารณสุขและสิทธิมนุษยชน เป้าหมายทางยุทธศาสตร์การจดัการคนต่างชาติเขา้เมือง
ผดิกฎหมายคือผลประโยชน์ของชาติทÉีตอ้งมีความมนัÉ คงและการเจริญเติบโตทางเศรษฐกิจอยา่ งต่อเนืÉอง
ยังยืน รวมทั É Êงมีความสัมพนั ธ์ทÉีดีกับต่างประเทศจึงต้องมียุทธศาสตร์ระยะยาวคือนโยบายทีÉทาํให้
โครงสร้างอายุประชากรสมดุล โดยเพิÉมอตัราเจริญพนัธุ์ให้เพียงพอยุทธศาสตร์ระยะสÊันคือให้มีแรงงาน
เพียงพอทัÊงปริมาณและคุณภาพ ลดผลกระทบและความเสีÉยงต่าง ๆ ทÊงความมั ั นÉ คงเศรษฐกิจ สาธารณสุข
และสิทธิมนุษยชน ทีÉจะเกิดขÊึน การวิจยันÊีมีขอ้เสนอแนะใหป้รับเปลÉียนทศันคติของหน่วยงานทÉีเกÉียวขอ้ง
บูรณาการเป้าหมายและนโยบายให้เกิดความสมดุลระหวา่ งความมนÉัคงเศรษฐกิจ สาธารณสุขและสิทธิ
มนุษยชน รวมทัÊงการสร้างมูลค่าเพÉมิในการใชแ้รงงานต่างชาติทุกภาคส่วน

Abstract
Title Illegal Migrant Management Strategy

The objectives of this qualitative study include : analysis of the illegal migrant situation and
its impacts, formulation of the strategy for illegal migrant management and recommendation. The study
focuses on migrants from Myanmar, Laos and Cambodia. Because of the very long border with Thailand, the
migrants could easily make an illegal cross-border. The methodology is consisted of literature review,
information collection, analysis and formulation of strategy and recommendation. The results show that there is
no effective and efficient law for illegal migrant management, the nationality approval of the migrant and
imported legal migrant are a difficult process and highly expensive. The main factor that causes illegal migrant
in Thailand is the reduction of Total Fertility Rate of Thai women that induces the imbalance of population age
structure, therefore Thailand is now facing with the shortage of labor workforce. At the same time, the income
disparity between Thailand and neighboring countries tend to be a less influencing factor because of the
increase income per capita of Laos and Cambodia and also the more open economy of Myanmar. The cabinet
has adopted policy for migrant which has been modified year by year according to the pressure from security
and economy organizations. This is not well balanced especially from the health and human right perspectives.
Apparently, security, economy, public health and also human right negative impacts and risks should be
addressed comprehensively to tackle the problem of illegal migrant. The strategy should focus on security,
sustainable economic growth and also improvement of the relationship with neighboring countries. The long
term strategy and policy should target on the increase of the Total Fertility Rate to balance Thai population age
structure thus ensuring the adequate and quality of the labor force in the long run. The short term strategies
include improvement of the migrant condition to be more productive with better quality of life, reduction of the
negative impacts and risks, adjust the multi-ministry officers attitude, integrate and harmonize all strategic goals
to balance security, economy, health and human right issues and also add value to the migrant workforce.
