คอมพิวเตอร์สามารถฉอ้โกงหลอกลวงทรัพยส์ินของผเู้สียหายไดท้ ีละจาํนวนมากกระทาํผิดในลกัษณะต่างๆ
ได้ง่าย รวดเร็วก่อให้เกิดปัญหาแก่ผู้บังคับใช้กฎหมายในด้านการสืบสวนสอบสวน การรวบรวม
พยานหลกัฐานการติดตามตวัคนร้ายมาลงโทษ
ปรากฏว่าผู้บังคับใช้กฎหมายทีÉมีความรู้ความเชีÉยวชาญในด้านกฎหมาย มีทักษะและ
ประสบการณ์การสืบสวนสอบสวน พร้อมทัÊงความรู้ความเชีÉยวชาญในด้านคอมพิวเตอร์ การใช้เทคโนโลยี
สมยัใหม่ยงัมีจาํนวนน้อยมาก ตอ้งรับภาระรับผิดชอบสํานวนคดีจาํนวนมากขาดขวญั และกาํลงัใจทÉีดี
เส้นทางความกา้วหนา้ไม่ชดัเจนการเลืÉอนตาํแหน่งการโยกยา้ย ทาํให้กาํลงัเจา้หนา้ทีÉขาดแคลนตอ้งใชเ้วลา

Abstract

computer related crimes

Due to the advancement of the technology and the increasing numbers of persons all over the
world who use computers and smartphones to communicate or conduct online businesses regardless of the time
differences and their locations, it is likely that such communications and business transactions are done without
sufficient knowledge on computer systems and on how to use these devices correctly. This often leads to the users
storing their data negligently or trusting information from online sources without a thorough consideration,
resulting in an increase in numbers of computer crimes and the users falling victims to these crimes. Computerrelated, or high-tech crimes are unique in the ways that the harm can be done against the victims so easily and
immediately, the crimes come in such a variety of forms, and these white-collar criminals are usually very capable
of keeping their identities secret. Thus, we need law enforcement officers with specialized expertise in order to
effectively detect the crimes, trace the criminals, searching for information, as well as gather related evidence.
Moreover, computer-related or high-tech crimes are often transnational and borderless in nature. For example, a
criminal may, because of their acts of computer fraud, obtain a considerable amount of money from a number of
victims residing in various countries with one simple click. As such, this creates problems for law enforcement
officers in the fields of crimes’ detection, investigation, evidence gathering, and offenders’ tracing and making
arrests.
Moreover, it appears that there are only a handful of law enforcement officers with not only legal
knowledge and expertise, skills, experience in investigation techniques, but also computer and technology skills.
Apart from that, these officers are burdened with too many cases, too little work incentives, and unclear career
paths and regular internal promotions and job rotations. To gain expertise in handling computer-related crimes, an
officer has to be specifically trained for a long time comparatively. That is why the usual system of internal
promotions and job rotations among law enforcement officers often lead to the lack of officers and, more
importantly, the time spent on the training of new officers on a regular basis. Apart from that, other problems include the lack of budget to provide for necessary equipment, the
lack of case-management expenses, the lack of opportunities for sufficient, comprehensive and continuous training
for law enforcement officers in all relevant agencies all over the country, the lack of the information sharing,
communications, and trainings between the public and private sectors. All these problems similarly lead to the lack
of officers to efficiently fight against computer-related crimes which are soaring and tend to rise even further in the
future.
