เรื่อง แนวทางการบังคับใช้กฎหมายเพื่อลดจ านวนผู้ต้องขังในเรือนจ า

งานวิจัยเรื่องนี้มีวัตถุประสงค์เพื่อเป็นแนวทางในการบังคับใช้กฎหมายในระดับนโยบายและ
การปฏิบัติเพื่อลดปัญหาผู้ต้องขังแน่นเรือนจ า และพัฒนาฟื้นฟูจิตใจ คุณภาพชีวิตของผู้ต้องขังก่อนกลับเข้า
สู่สังคมหลังการพ้นโทษ รวมทั้งวิธีการที่เหมาะส าหรับการควบคุมผู้ต้องหาที่อยู่ระหว่างการด าเนินการใน
ชั้นพนักงานสอบสวน อัยการ และศาล ผู้วิจัยได้ใช้วิธีศึกษาเปรียบเทียบจากมาตรการบังคับใช้กฎหมายที่ใช้
ในปัจจุบันกับประเทศต่างๆ เช่น ประเทศญี่ปุ่น อังกฤษ สหรัฐอเมริกา สหพันธ์สาธารณรัฐเยอรมนี และ
ฝรั่งเศล เป็นต้น ผลจากการศึกษาพบว่า ในระดับนโยบายมีประกาศของประธานศาลฎีกาและกฎหมาย
ก าหนดแนวทางไว้ชัดเจน แต่ในระดับปฏิบัติยังไม่มีการตอบสนองเท่าที่ควร เพราะเกรงผู้ต้องหาจะหลบหนี
และเพื่อความสะดวกในการสอบสวนคดี
การแก้ไขปัญหาจึงจ าเป็นต้องแก้ไขที่ต้นเหตุแห่งปัญหาที่แท้จริง ตั้งแต่ระดับครอบครัว สังคม
สิ่งแวดล้อม การศึกษาและเศรษฐกิจของชาติ ซึ่งเป็นปัญหาพื้นฐานต่อการด ารงชีพและมีผลการตัดสินใจที่
จะก่ออาชญากรรมขึ้น รัฐควรเร่งแก้ไขเศรษฐกิจเพื่อสร้างอาชีพ รายได้ที่มั่นคงและเพียงพอต่อการ
ด ารงชีวิต นอกจากนี้ควรทบทวนบริบทการบังคับใช้กฎหมายและการบูรณาการระหว่างหน่วยงานในระบบ
กระบวนการยุติธรรม มีขั้นตอนกระบวนงานที่กระชับรวดเร็วและเป็นไปในทิศทางเดียวกันอย่างเหมาะสม
และมีประสิทธิภาพ ประสิทธิผล สังคมปลอดภัย การใช้อุปกรณ์อิเล็กทรอนิกส์(Electronic Monitoring)
หรือ EM เพื่อการควบคุมผู้ต้องขังในระหว่างการสอบสวน การพิจารณาคดี และหลังมีค าพิพากษา
