สถานการณ์ปัญหายาเสพติดในปัจจุบัน ได้แพร่ระบาดและทวีความรุนแรงเพิ่มมากขึ้น ทุก
ปีถือเป็นภัยคุกคามที่กัดกร่อนบ่อนท าลายประเทศชาติส่งผลกระทบโดยตรงต่อความมั่นคงในชีวิตและ
ทรัพย์สินของมวลมนุษยชาติ รวมทั้งความมั่นคงทางเศรษฐกิจ การเมือง และอธิปไตย ของนานา
อารยประเทศ จึงมีความจ าเป็นอย่างยิ่งและถือเป็นปัญหาเร่งด่วน รัฐบาลทุกยุคทุกสมัย ถือเป็นเรื่อง
ส าคัญและให้ปัญหาดังกล่าว เป็นวาระแห่งชาติ
แม้ประเทศไทยได้มีการท าสงครามต่อสู้กับยาเสพติดมาเป็นระยะเวลาอันยาวนาน แต่ก็ยัง
ไม่บรรลุถึงผลสัมฤทธิ์สูงสุดในลักษณะของการควบคุมปัญหายาเสพติดได้อย่างสิ้นเชิง สาเหตุส าคัญสืบ
เนื่องมาจากการพัฒนาของโลกในยุคปัจจุบัน และวิวัฒนาการทางเทคโนโลยีมีเทคนิควิธีการสมัยใหม่
เป็นเครื่องมือ มีการติดต่อสื่อสารและการคมนาคมแห่งยุคโลกาภิวัฒน์(Globalization) ที่เอื้อประโยชน์
อย่างยิ่งต่อการประกอบอาชญากรรม จะเห็นได้ว่าสังคมไทยมิได้เผชิญเฉพาะปัญหาอาชญากรรมพื้นฐาน
แต่ก าลังเผชิญกับปัญหาอาชญากรรมพิเศษที่มีการพัฒนา รูปแบบวิธีการด าเนินการอย่างต่อเนื่อง เป็น
ระบบ และมีลักษณะเป็นเครือข่าย ผู้กระท าความผิดมีความรู้ ความเชี่ยวชาญ ก่อความเสียหายและ
ผลกระทบรุนแรงต่อระบบเศรษฐกิจ การเมืองและ ความมั่นคงของประเทศ
โครงสร้างของอาชญากรรมยาเสพติด ประกอบด้วยส่วนส าคัญอยู่ 3 ส่วน คือ
1. คน อันได้แก่ ผู้กระท าความผิด
2. ยาเสพติด อันได้แก่ วัตถุหรือสิ่งของต้องห้ามตามกฎหมาย
3. เงิน ทรัพย์สินหรือรายได้จากการกระท าความผิด
ดังนั้น หากภาครัฐต้องการเอาชนะสงครามยาเสพติด จึงจ าเป็นต้องท าลายโครงสร้าง
ดังกล่าวให้หมดไปอย่างเด็ดขาด ซึ่งต้องด าเนินการในทุกด้าน นอกจากมาตรการทางบริหารแล้ว
มาตรการทางกฎหมาย็มีความส าคัญอย่างมากที่จะควบคุมหรือลดการแพร่ระบาดของยาเสพติดได้อย่าง
มีประสิทธิภาพ ถือเป็นมาตรการหลักในการปราบปรามยาเสพติด และที่ส าคัญต้องไม่ละเลยที่จะด าเนิน
มาตรการด้านการป้องกัน ด้วยการเสริมสร้างความรู้ความเข้าใจถึงปัญหาหรือผลกระทบของปัญหาหรือ
อาชญากรรมยาเสพติด

As the current drug problem situation, the epidemic has become more and
more severe every year. it is a threat that can erode the nation, directly affect the
security of life and property of mankind including economic, political and sovereignty
of many civilized countries. It is therefore very necessary and considered an urgent
problem. Every government puts it as an important and national agenda. Although
Thailand has been fighting drugs for a long time, it has not been achieved yet.
The main cause is the development of the world today, and the evolution of
technology. There are modern techniques and method as tools. There is communication
and transportation of the globalization era which are beneficial to committing crime.
It can be seen that Thai society does not encounter only the basic
crimes, but also special crimes which have evolved in the method of continuous and
systematic actions. Criminals have knowledge and expertise able to cause severe
impact on the economy, politics and national security.
Drug crime structure consists of three important parts:
1. People including the offender
2. Drugs, which are objects or illegal items
3. Money, property, or incomes from the commission of the offense
Therefore, if the government wants to win the drug war, it is necessary to
absolutely destroy such the structures in all aspects. In addition to administrative
measures, legal measures are particularly important to effectively control or reduce the
spread of drug abuse. These are the main measures suppress drugs. Moreover, it is a
must not to neglect to take preventive measures by boosting people’s knowledge and
understanding of the problems or the effects of drug crimes.
