ภูมิรัฐศาสตร์ของประเทศไทยที่เชื่อมต่อกับมหาสมุทรแปซิฟิก และมหาสมุทรอินเดีย
ถือเป็นปัจจัยที่เกื้อกูลต่อศักยภาพในการแสวงประโยชน์จากทะเล เพื่อการพัฒนาประเทศให้มีความมั่งคั่ง
มั่นคง และยั่งยืน อย่างไรก็ตาม ผลกระทบจากภัยพิบัติที่นับวันจะทวีความรุนแรง และมีแนวโน้มที่จะ
เกิดถี่ขึ้นเรื่อย ๆ เนื่องมาจากสภาวะโลกร้อน (Global Warming) และการแปรปรวนของสภาพ
ภูมิอากาศ (Climate Change) ภัยพิบัติทางทะเลที่อาจเกิดขึ้น อาทิพายุหมุนเขตร้อน (Tropical Cyclone)
คลื่นสึนามิ(Tsunami) คลื่นพายุซัดฝั่ง (Strom Surge) และการรั่วไหลของน้ ามันในทะเล (Oil Spill)
อาจก่อให้เกิดความเสียหายและส่งผลกระทบต่อชีวิตและทรัพย์สินอย่างมหาศาลในวงกว้าง ดังนั้น
จ าเป็นต้องมีการเตรียมการรับมือให้ได้อย่างรวดเร็วและทันเหตุการณ์
อนึ่ง การรักษาผลประโยชน์ของชาติทางทะเลโดย “ศูนย์ประสานการปฏิบัติในการรักษา
ผลประโยชน์ของชาติทางทะเล” หรือ ศรชล.(เดิม) ที่ผ่านมานั้น ประสบปัญหาทั้งด้านโครงสร้างองค์กร
ด้านการบริหารจัดการ ด้านก าลังพล และด้านงบประมาณ ซึ่งส่งผลต่อบทบาทในการบรรเทา
ภัยพิบัติในทะเลของ ศรชล.(เดิม) มีความไม่ชัดเจน และมีข้อจ ากัด ภาพความเป็นจริงที่ปรากฏ คือ
กองทัพเรือ เป็นหน่วยที่เข้าไปด าเนินการ ทั้งนี้ เมื่อมีการยกระดับ ศรชล.(เดิม) เป็นศูนย์อ านวยการ
รักษาผลประโยชน์ของชาติทางทะเล หรือ ศรชล.(ใหม่) จึงเป็นที่มาและวัตถุประสงค์ส าคัญในการวิจัย
ครั้งนี้ เพื่อก าหนดบทบาทและสร้างกลไกในการบริหารจัดการสาธารณภัยในทะเลของ ศรชล.(ใหม่)
ซึ่งผลการวิจัยพบว่าการยกระดับ ศรชล.(เดิม) เป็นศูนย์อ านวยการรักษาผลประโยชน์ของชาติทางทะเล
ตามพระราชบัญญัติการรักษาผลประโยชน์ของชาติทางทะเล พ.ศ.๒๕๖๒ ท าให้ ศรชล.(ใหม่) มีอ านาจ
หน้าที่ตามกฎหมาย และมีความชัดเจนในการมีบทบาทและเป็นกลไกหลักในการบรรเทาสาธารณภัย
ทางทะเล อย่างไรก็ตาม เพื่อป้องกันมิให้เกิดปัญหาเช่นเดียวกับการปฏิบัติที่ผ่านมาของ ศรชล.(เดิม)
จ าเป็นต้องมีการด าเนินการทั้งในเชิงนโยบาย และการน าไปปฏิบัติ อาทิ การจัดท าแผนการป้องกันและ
บรรเทาสาธารณภัยของชาติทางทะเล การปรับปรุงระเบียบกระทรวงการคลังว่าด้วยเงินทดรองราชการ
เพื่อช่วยเหลือผู้ประสบภัยพิบัติกรณีฉุกเฉิน พ.ศ.๒๕๖๒ ให้ครอบคลุมภัยพิบัติในทะเล การจัดท าแผน
ป้องกันและขจัดมลพิษทางน้ าเนื่องจากน้ ามันให้มีความทันสมัย และการจัดให้มีการฝึกซ้อมการป้องกัน
และบรรเทาสาธารณภัยในทะเลอย่างสม่ าเสมอ เป็นต้น

Geopolitics of Thailand that connect to the Pacific Ocean and the Indian
Ocean considered as a contributing factor to the potential for exploitation from the
sea for the development of the country to be prosperous, stable, and sustainable.
However, the impact of the disaster is intensifying nowadays. And tends to occur
more frequently due to global warming and climate change. Marine disasters that
may occur, such as Tropical Cyclone Tsunami Strom Surge and Oil Spill. They have
caused enormous damage and impact on life and property in a large extent.
Therefore, we need a preparation to prepare to deal with it quickly and instantly.
In addition, to protect the national interests of the sea by Thailand
Maritime Enforcement Coordinating Center or THAIMECC (Old) in the past Faced
problems both in terms of organizational structure Manpower management and
budgeting, Which affects its role in mitigation the disaster in the sea of THAIMECC
(Old) is unclear and there are limitations. The reality appeared that the Royal Thai
Navy is a agency that went into operation. In this regard, when the THAIMECC (Old)
was promoted to the Thai Maritime Enforcement Command Center or THAIMECC (New)
so, it was an important source and objective in this research. To define roles and
create mechanisms for managing the disaster at sea of THAIMECC (New). The results
of the research showed that the elevation of the THAIMECC (Old) was the Thai
Maritime Enforcement Command Center, According to the National Marine Interests Act,
B.E. 2562 (2019), the THAIMECC (New) has legal powers and duties and there is a clear
play of a role and a primary mechanism in disaster mitigation at sea. However, to
prevent problems like THAIMECC (Old) practices, it is necessary to implement both
policy and practice. And implementation such as preparing national disaster
prevention and mitigation plans at sea Improvement of the regulations of the Ministry
of Finance on Government Advances for Helping Disaster Victims in Emergencies B.E.
2562 (2019) to cover disasters at sea. Developing a modern oil pollution prevention
and elimination plan and to organize disaster prevention and mitigation drills at sea
regularly etc.
