เอกสารวิจัยเรื่อง “แนวทางการแกไข ฟนฟู เด็กและเยาวชนที่กระทําความผิด และมี
พฤติกรรมความรุนแรง โดยกระบวนการยุติธรรม”มีวัตถุประสงค/เพื่อศึกษาสาเหตุของความรุนแรง
ของเด็กและเยาวชน ป4จจัยที่กําหนดพฤติกรรมการใชความรุนแรง ผลกระทบจากความรุนแรง การ
ป6องกันการเกิดพฤติกรรมความรุนแรง และ เพื่อเสนอทางออกที่ดีที่สุดในการแกไขป4ญหา โดยผ8าน
กระบวนการยุติธรรมในกรอบของกระบวนการยุติธรรมทางเลือก ร8วมกับ บทบาทขององค/กรเอกชน
การศึกษา พบว8า ป4จจัยที่มีแนวโนมต8อพฤติกรรมความรุนแรงของเด็กและเยาวชนเกิด
จาก 3 ป4จจัย ไดแก8 ป4จจัยส8วนตัว ป4จจัยดานครอบครัว ป4จจัยดานสังคมและสภาพแวดลอม นําขอมูล
เป;นแนวทางในการป6องกันและแกป4ญหาพฤติกรรมความรุนแรงของเด็กและเยาวชนกระทําผิด และ
การกระทําผิดกฎหมายระดับที่ไม8ซับซอนรุนแรง และแกไขฟนฟูผูที่กระทําผิดในชุมชน โดยผ8าน
กระบวนการยุติธรรมหลัก ไดแก8 กรมพินิจและคุมครองเด็กและเยาวชน กรมคุมประพฤติ ร8วมกับ
กระบวนการยุติธรรมทางเลือก ไดแก8 กระบวนการยุติธรรมชุมชน และกระบวนการยุติธรรมเชิง
สมานฉันท/ กระบวนการยุติธรรมทางเลือก มีเป6าหมาย เพื่อทําใหทุกฝ@ายซึ่งไดรับผลกระทบจาก
อาชญากรรมมีโอกาสกลับคืนสู8สภาพดีเช8นเดิม ช8วยสรางความสมานฉันท/ในสังคม การเยียวยาความ
เสียหายที่เกิดขึ้นแก8ผูเสียหายและสังคม รวมทั้งการนําผูกระทําผิดกลับคืนสู8สังคม(reintegration)
แนวทางการแกไข ฟนฟู เด็กและเยาวชนที่กระทําความผิด และมีพฤติกรรมความรุนแรง
นั้น ภาครัฐ เอกชน และชุมชนจําเป;นตองปฏิบัติงานแบบบูรณาการ ปรับปรุงกฎหมาย กฎ ระเบียบ
ใหเหมาะสมกับสภาพป4จจุบัน และบังคับใชกฎหมายอย8างเคร8งครัดเพื่อป6องกันไม8ใหเด็กและเยาวชน
เขาถึง สิ่งของอันตรายที่ใชกระทําความรุนแรง สนับสนุนใหองค/กรเอกชนและชุมชนเขามีส8วนร8วมใน
การดําเนินการ จัดใหมีการประสานการดําเนินงานในรูปแบบสหวิชาชีพเพื่อแกไข ฟนฟู โดยคํานึงถึง
สภาพป4ญหา ความตองการ และพัฒนาการของเด็กและเยาวชนเป;นรายบุคคล เพื่อป6องกันไม8ใหเกิด
กระทําความรุนแรงซ้ํา และช8วยเหลือ ฟนฟูเด็กและเยาวชนที่เป;นผูกระทําความรุนแรงเพื่อใหกลับสู8
สังคมอย8างมีคุณภาพ

Abstract
Title The rehabilitation for the juvenile offenders having violent
behavior by the justice system

The research on the resolution to the juvenile offenders’ violent behavior
by the justice system aims to study the causes of juvenile’s violence, factors
determining violent behavior, effects from violence, protection to violent behavior;
and to propose the best and proper resolution to these problems through the justice
system, within the framework of justice procedures working with the private sector’s
roles.
The study found that factors relating to juvenile’s violent behavior came
from 3 sources, they were: individual, family, social and environment factors. The
obtained information was used to present ways to prevent and solve violent
behavior of those juvenile committing an offence that was not so severely
complicated, and rehabilitate the offenders through the main justice procedures:
they are department of juvenile observation and protection, and department of
probation, and also through the alternative justice procedures: they are community
justice process and reconciliation of justice. The objectives of alternative justice are
to help the parties involved of the offences’ effect could be back into the
community as before; heal the losses to sufferers and community, as well as
reintegrate those reformers back to the community.
The rehabilitation of juvenile offenders having violent behavior should
integrate the working of all the public, private and community sectors; improve
relating laws, rules and regulations properly and suitably to the present condition, as
well as enforce them strictly in order to prevent juvenile approaching the materials
relating to violent; support the non-governmental organization and community joining
into the process; set up the coordination of multidisciplinary working for
rehabilitation, by considering existing problem condition, demand, development of
each juvenile case by case in order to prevent the reoccurrence of violent incidents; ฃ
and assist the juvenile who commit violent rehabilitating and reintegrating back to
the community with quality.
