เรื่อง แนวทางการกําหนดมาตรการทางกฎหมายเพื่อการแกไขปญหาการคามนุษย
ในประเทศไทย

เอกสารวิจัยฯ ฉบับนี้ จัดทําขึ้นโดยมีวัตถุประสงค เพื่อศึกษาและวิเคราะห ความเป5นมา
และรูปแบบของการคามนุษย ในประเทศไทย เพื่อศึกษาปญหาและอุปสรรคในการบังคับใชกฎหมาย
ต6างๆ ที่เกี่ยวของ และพระราชบัญญัติป8องกันและปราบปรามการคามนุษย พ.ศ.๒๕๕๑ พ.ศ.๒๕๕๘
(ฉบับที่ ๒) และ พ.ศ.๒๕๖๑ (ฉบับที่ ๓) เพื่อศึกษายุทธศาสตร ชาติ (พ.ศ.๒๕๖๑ – ๒๕๘๐) ประเด็น
ยุทธศาสตร ชาติ ๔.๑ ยุทธศาสตร ชาติดานความมั่นคง และเพื่อหาแนวทางการกําหนดมาตรการทาง
กฎหมายเพื่อการแกไขปญหาการคามนุษย ในประเทศไทย โดยใชวิธีการวิจัยเชิงคุณภาพที่ผูวิจัยไดเนน
การวิจัยเกี่ยวกับสถานการณ การคามนุษย ในประเทศไทย กฎหมายต6างๆ และพระราชบัญญัติป8องกัน
และปราบปรามการคามนุษย และยุทธศาสตร ชาติ (พ.ศ.๒๕๖๑ – ๒๕๘๐) ประเด็นยุทธศาสตร ชาติ
๔.๑ ยุทธศาสตร ชาติดานความมั่นคงการเก็บรวบรวมขอมูลแบ6งเป5น ๒ ส6วน ไดแก6 (๑) การเก็บรวบรวม
ขอมูลทุติยภูมิ วิเคราะห สถานการณ การคามนุษย ในประเทศไทย กฎหมายต6างๆ และพระราชบัญญัติ
ป8องกันและปราบปรามการคามนุษย ยุทธศาสตร ชาติ (พ.ศ.๒๕๖๑ – ๒๕๘๐) ประเด็นยุทธศาสตร
ชาติ ๔.๑ ยุทธศาสตร ชาติดานความมั่นคงโดยมุ6งเนนการวิจัยจากเอกสารทางวิชาการ บทความทาง
วิชาการ แนวคิดที่เกี่ยวของ และสื่อสิ่งพิมพ ต6างๆ รวมทั้งสื่ออิเล็กทรอนิกส (๒) การเก็บรวบรวมขอมูล
ปฐมภูมิ โดยการเก็บรวบรวมขอมูลดวยวิธีการสัมภาษณ เชิงลึกผูทรงคุณวุฒิที่เกี่ยวของกับแนวทางการ
กําหนดมาตรการทางกฎหมายเพื่อการแกไขปญหาการคามนุษย ในประเทศจากภาคส6วนต6างๆ ที่เกี่ยวของ
ทั้งนี้ ผลการวิจัย สรุปไดว6าการคามนุษย ยังคงเป5นประเด็นปญหาที่น6าเป5นห6วงมากยิ่งขึ้น ยิ่งนานวันกลับ
จะยิ่งลุกลามแพร6หลายเรื่อยมาในสังคมไทย โดยจะปรากฏรูปแบบการคามนุษย ไม6ว6าจะเป5นการคามนุษย
เพื่อการบังคับทางแรงงาน หรือการคามนุษย เพื่อการคาประเวณี ผลกระทบจากการตกเป5นเหยื่อของ
การคามนุษย ทําใหเกิดความเสียหาย ไม6ว6าดานร6างกายหรืออนามัยของเหยื่อ ส6วนผลกระทบทางดาน
สังคม เช6น การคามนุษย เป5นการละเมิดสิทธิมนุษยชน การคามนุษย ขัดขวางต6อการพัฒนาสังคมและ
ชุมชน และเป5นการส6งเสริมอาชญากรรมที่เป5นองค กร อีกทั้งยังเป5นการทําลายทรัพยากรมนุษย ของ
ประเทศ ปญหาการคามนุษย นั้นถือเป5นปญหาที่สําคัญอันเร6งด6วนในการป8องกันและปราบปราม
โดยเฉพาะอย6างยิ่งประเทศไทยไดตกลงเป5นภาคีตามอนุสัญญาว6าดวยการต6อตานการคามนุษย ดวยแลว
ประเทศไทยจึงมีพันธะตองดําเนินการเกี่ยวกับปญหาดังกล6าวอย6างจริงจัง ในการกําหนดมาตรการทาง
กฎหมายเพื่อการแกไขปญหาการคามนุษย ในประเทศไทยซึ่งประเทศไทยควรสอบสวนและดําเนินคดีกับ
เจาหนาที่รัฐที่ถูกกล6าวหาว6ามีส6วนสมรูร6วมคิดในการคามนุษย พรอมทั้งดําเนินการพิพากษาและลงโทษ
เจาหนาที่ที่พบว6ามีความผิดจริงอย6างเขมงวด การสรางความตระหนักรูการต6อตานการคามนุษย
ซึ่งรวมถึงสรางความตระหนักรูใหแก6นายจางและผูใชบริการธุรกิจทางเพศดวย เช6น นักท6องเที่ยวที่มี
ความสนใจดานประเวณี ไทยควรยกระดับสิทธิ สถานะทางกฎหมาย และนโยบายการเขาเมืองของ
แรงงานต6างดาวเพื่อลดความเสี่ยงการคามนุษย ใหนอยที่สุด

ABSTRACT
Title Integrated approach for determining legal measures for
combating trafficking in persons problems in Thailand.

This research paper aims to study and analyze the history and forms of trafficking in
persons in Thailand. To study problems and obstacles in the enforcement of various laws
associated and the Prevention and Suppression of Trafficking in Persons Act 2008, 2015 (Issue 2)
and 2017 (Issue 3), to study the National Strategy (2018 – 2037) National Strategy issue 4.1 for
security strategies. To find integrated approach for determining legal measures for combating
trafficking in persons problems in Thailand. By using qualitative research methods that the
researcher has focused on research on the situation of trafficking in persons in Thailand, various
laws and the Prevention and Suppression of Trafficking in Persons Act and the National Strategy
(2018 – 2037), National Strategy issues 4.1 for security strategies. Data collection is divided into 2
parts; (1) secondary data collection by analyze the situation of trafficking in persons in Thailand,
various laws and the Prevention and Suppression of Trafficking in Persons Act. National Strategy
(2018 – 2037), National Strategy issues 4.1for security studies. Focusing on research from
academic documents, academic articles, related concepts and various publications including
electronic media, (2) primary data collection by collecting data of in-depth interviews with
experts related to the integrated approach for determining legal measures for combating
trafficking in persons problems from various sectors associated. The results of the research
concluded that trafficking in persons is still a more worrisome issue. In a longtime will become
more widespread in Thai society, with the appearance of trafficking in persons, whether human
trafficking for labor force or trafficking in persons for prostitution. The consequences of being a
victim of trafficking in persons cause damage. Regardless of the physical or health of the victim,
as for social impacts such as trafficking in persons, it is a violation of human rights. Trafficking in
persons hinders social and community development and is promoting crime that is an
organization. It also destroys human resources of the country. The problem of trafficking in
persons is considered an urgent problem that is important to prevent and suppress. In particular
Thailand has also agreed to be a party to the convention on Anti-Trafficking in Persons. Thailand
is therefore obliged to take action on such issues seriously. In determining legal measures for
combating trafficking in persons problems in Thailand, which Thailand should investigate and
prosecute officials accused of conspiracy in trafficking in persons and preceded to judge and
punish officials who found that there was a serious offense. To awareness building on AntiTrafficking in Persons which includes raising awareness for employers and users of sexual business
services, such as tourists with sexual interest, Thailand should raise the level of rights legal status
and immigration policies of foreign workers to reduce the risk of trafficking in persons.
