งานวิจยัฉบบั น้ีมีวตัถุประสงค์เพื่อศึกษาสถานะปัจจุบนัของกฎหมายลม้ละลายไทย
ในส่วนที่เกี่ยวกับต่างประเทศ และศึกษาหลักการ แนวความคิด รวมถึงข้อดีและข้อด้อยของ
กฎหมายแม่แบบของคณะกรรมธิการกฎหมายการคา้ระหว่างประเทศแห่งสหประชาชาติค.ศ.๑๙๙๗
เป็ นแนวทางในการพัฒนาพระราชบัญญัติล้มละลาย พ.ศ.๒๔๘๓ ในส่วนที่เกี่ยวกบัการลม้ละลาย
เกี่ยวกับต่างประเทศเฉพาะประเด็นสิทธิของผูแ้ ทนต่างประเทศในการเข้ามาในประเทศไทย
งานวิจยัฉบบั น้ีเป็นการวิจยัเชิงคุณภาพ โดยศึกษาคน้ ควา้เอกสาร ตา รา ท้งัของประเทศไทยและ
ต่างประเทศ เพื่อรวบรวมและวิเคราะห์ประเด็นปัญหาของกฎหมายล้มละลายข้ามชาติของประเทศ
ไทยในปัจจุบนั ที่ควรไดร้ับการพฒั นา ปรับปรุงแกไ้ข พร้อมเสนอแนะแนวทางการแกไ้ข ปรับปรุง
โดยเนน้ ประเด็นสิทธิในการเขา้มาในประเทศไทยของผแู้ทนต่างประเทศ
ดงัน้นั งานวิจยัฉบบั น้ีจะเป็นประโยชน์ในแง่ของการไดท้ ราบวา่ ประเทศไทย มีการ
เปลี่ยนผา่ นแนวความคิดในเรื่องการลม้ละลายขา้มชาติของต่างประเทศจากระบบทฤษฎีความเป็นเขตแดน
(Territorialism) เป็ นระบบทฤษฎีสากลนิยม (Universalism) ซึ่ งต้องมีกฎหมายล้มละลายข้ามชาติ
ในทุกๆ ประเทศที่มีการอนุวัติกฎหมายล้มละลายข้ามชาติเข้ามาเป็ นกฎหมายภายในของประเทศตนเอง
ตามที่คณะรัฐมนตรีได้มีมติเมื่อวันที่ ๒๗ ธันวาคม พ.ศ.๒๕๕๗ อนุมตัิหลกัการร่างพระราชบญั ญตัิ
ลม้ละลาย(ฉบบั ที่...) พ.ศ... ตามที่กระทรวงยุติธรรมเสนอและส่งให้ส านกังานคณะกรรมการกฤษฎีกา

The research aims to study the current status of Thai Bankruptcy Law in relation to
foreign countries and study the principles, concepts including the advantages and disadvantages of
the Model Law of the United Nations International Trade Commission Act, 1997, as a guideline
for the development of the Bankruptcy Act BE 2483 in relation to foreign bankruptcy Only the
rights of foreign representatives in Thailand.
This research is a qualitative research. By studying and researching from textbooks
both in Thailand and abroad In order to collect and analyze the current issues of the Cross-Border
Insolvency Law of Thailand that should be developed, revised, and suggest solutions to improve
by emphasizing the rights to enter Thailand by foreign representatives
Therefore, this research will be useful to know that Thailand has changed through the
concept of cross-border insolvency of foreign countries from the boundary theory system
(Territorialism) is the universalism theory systems (Universalism), which requires a cross-border
insolvency law in every countries that have implemented the cross-border insolvency law into their
own domestic laws. According to the Cabinet's resolution on December 28, 2016, approved the
principle of the Bankruptcy Act (No. ...), BC... as proposed by the Ministry of Justice and sent to
the Office of the Council of State for consideration.
