ผลการวิจยัพบว่ากฎหมายได้กาํหนดอาํนาจหน้าทีÉในการดูแลรักษาและการแก้ไขปัญหา
การบุกรุกไวห้ลาย ๆ หน่วยงาน โดยระดบั นโยบายอนัไดแ้ก่กระทรวงมหาดไทยกรมการปกครองและ
กรมทีÉดิน สําหรับระดับปฏิบตัิได้แก่จงัหวดั อาํ เภอองค์กรปกครองส่วนท้องถิÉน กาํ นัน ผูใ้หญ่บ้าน
อย่างไรก็ตามเนืÉองจากปัญหาการบุกรุกทีÉดินสาธารณประโยชน์มีความสลบั ซับซ้อน รัฐบาลจึงได้มี
การแต่งตÊงั “คณะกรรมการแก้ไขปัญหาการบุกรุกทีÉดินของรัฐ” เรียกโดยย่อว่า“กบร.” ขึÊน เพืÉอให้เป็ น
กลไกในการแกไ้ขปัญหาการบุกรุกทÉีดินของรัฐ
ในการแก้ไขปัญหาการบุกรุกทีÉดินสาธารณประโยชน์ของทุกหน่วยงาน มีปัญหาและ
ขอ้จาํกดั มากไดแ้ก่สภาพทีÉดินของรัฐมีขอบเขตไม่ชดัเจน เจา้หน้าทีÉของรัฐขาดความรู้ความเชีÉยวชาญ
ในการปฏิบัติหน้าทีÉ เจา้หน้าทีÉมีไม่เพียงพอในการดูแลรักษาการไม่เอาใจใส่ในการดูแลรักษาและ
คุ้มครองป้องกันทÉีดินสาธารณประโยชน์ นโยบายของรัฐในการแก้ไขปัญหาการบุกรุกไม่ชัดเจน
ประชาชนขาดจิตสํานึกสาธารณะในการดูแลรักษาและป้องกนั ทีÉดินสาธารณประโยชน์ และปัญหาการ
ซํÊาซ้อนของกฎหมายในเรืÉองอาํนาจหนา้ทÉีของหน่วยงานทÉีมีอาํนาจดูแลจดัการทีÉดินสาธารณประโยชน์
ผูว้ิจยัเสนอวธิีการจดัองคก์รเชิงบูรณาการในการแกไ้ขปัญหาดงักล่าวโดยให้มีคณะทาํงาน
บูรณาการรจัดการและแก้ไขปัญหาทีÉดินสาธารณประโยชน์ระดับจังหวดั ระดับอําเภอ และ
คณะทาํงานทีÉดินสาธารณประโยชน์ประจาํแปลง โดยบูรณาการการทาํงานทÊงัส่วนราชการทีÉมี

ABSTRACT
Title The Integrated Management for Solving the Problem of Public Land
Encroachment

This qualitative study intends to explore the approach and administrative management for
the resolutions of public land encroachment in Thailand as well as to provide a possible suggestion at the
end. This study collects data from the relevant laws, regulations and other legal documents in which
directions and imperative rules are advised for the authorities. In addition, a number of case studies
illuminating the working and successful resolutions and difficulties in executing the measures of public
land encroachment are elicited for analysis and further suggestions.
The study points out that there are certain of authority organizations in charge of the issue
of public land encroachment. They are the Ministry of Interior (MOI), the Department of Provincial
Administration (DOPA), and the Department of Land. The working units in the local areas are the
provincial administration, district administration, local administration, in the cooperation with local
leaders, i.e., sub-district headmen and heads of villages. However, the problem of public land
encroachment still persists due to its complication in many aspects and stakeholders. This conundrum
results in the establishment of Commission for the Public Land Encroachment Resolutions
(คณะกรรมการแก้ไขปัญหาการบุกรุกทีÉดินของรัฐ: กบร.) as a key performer to terminate the constant
issues of public land mismanagement.
The limitations of working government agencies are under staff and inadequate knowledge
and expertise in dealing with public land encroachment issue. Further, the ambiguity of land boundaries,
unawareness of local people to protect their public resources, and redundancy of authorities are additional
causes of the ongoing public land encroachment.
The Integrated Management for solving the problem of public land encroachment is
recommended as a suggestion. This study suggests having a small working unit of the Commission for
the Public Land Encroachment Resolutions in sub-levels: provincial, district, and targeted zones. The - 2 -
related government agencies in the policy of public land encroachment may have to send their staffs to be
part of this working group to work together with representatives from the civil sector. This integrated
management model would incorporate people, budget and resources to ease the problem of public land
encroachment.
