การวิจยัเรืÉองนีÊมีวตัถุประสงค์เพÉือศึกษานโยบาย มาตรการในการจดัระเบียบแรงงาน
ต่างด้าวผิดกฎหมายเพืÉอศึกษาปัญหาและอุปสรรคในการนํานโยบายและมาตรการในการจัดระเบียบ
แรงงานต่างด้าวผิดกฎหมายไปสู่การปฏิบตัิ และเพืÉอให้ได้ขอ้ เสนอแนะในเชิงนโยบาย จากการ
วิเคราะห์การดําเนินงานตามนโยบายมาตรการในการจดัระเบียบแรงงานต่างด้าวทีÉผิดกฎหมาย
แก่ผทู้ีÉเกีÉยวขอ้ง
ผลการวิจยั พบว่า เป็ นทีÉทราบกันดีว่าการพัฒนาเศรษฐกิจและสังคมของประเทศ
จาํ เป็นตอ้งอาศยัแรงงาน ซÉึงเป็นปัจจยัในการผลิตทีÉสําคญั ประการหนÉึง ประเทศไทยในปัจจุบนั
มีความตอ้งการแรงงานในปริมาณทีÉสูงโดยเฉพาะแรงงานในภาคเกษตรกรรม และงานในระดบัล่าง
เนืÉองด้วยปริมาณของประชากรวยัทาํงานของไทยลดลงอยา่ งมากและเป็นวยัพÉึงพาเพิÉมขึÊน รวมถึง
อตัราการเกิดก็ลดลง ทาํให้แรงงานในระดบัล่างของไทยขาดแคลนและตอ้งพÉึงพาแรงงานต่างดา้ว
เป็นจาํนวนมาก
การแก้ไขปัญหานÊี ในระดับการปฏิบตัิจะต้องดาํ เนินนโยบายทีÉยืดหยุ่นต่อแรงงาน
ต่างดา้วกาํหนดเป็นพÊืนทีÉเฉพาะ หรือเขตเศรษฐกิจเฉพาะให้ชุมชนและประชาชนในพืÊนทีÉมีส่วนร่วม
ในการกาํ หนดนโยบายกําหนดมาตรการ เงÉือนไข เพืÉอดาํ เนินการสําหรับกลุ่มแรงงาน ทาํความ
เขา้ใจ รวมทÊงัจูงใจแก่เจา้หนา้ทÉีในระดบัการปฏิบตัิให้มีความเขา้ใจในนโยบายและแนวทางปฏิบตัิ
อย่างเคร่งครัดและ ดาํ เนินมาตรการปราบปรามแรงงานต่างดา้วทÉีหลบหนีเขา้เมืองโดยไม่เป็นไป
ตามเงืÉอนไขทีÉกาํหนดกาํหนดมาตรการระบบการส่งกลบั ทีÉเหมาะสม และใหก้ารคุม้ครองสภาพการ
จ้าง ส่วนระดับการบริหารจดัการนัÊน จะต้องพฒั นาระบบข้อมูลแรงงานต่างด้าวอย่างครบวงจร
ปรับปรุงระบบการทาํงาน จดั ตÊงัศูนยบ์ ริหารงานแรงงานต่างดา้วทีÉเบ็ดเสร็จ สร้างช่องทางและเปิด
โอกาสให้ผู้มีส่วนได้เสียในการใช้แรงงานต่างด้าวเข้ามามีส่วนร่วมในการบริหารจัดการแรงงาน
ต่างดา้วรวมทัÊงจดัสรรงบประมาณ บุคลากรอยา่ งเพียงพอ
ในระดับนโยบาย จะต้องกําหนดให้การบริหารจัดการแรงงานต่างด้าวเป็นวาระ
แห่งชาติเพืÉอป้องกันผลกระทบต่อความมนัÉ คงแห่งชาติในดา้นต่างๆ ทÊงัเศรษฐกิจ สังคมจิตวิทยา
การเมือง และสิÉงแวดลอ้ ม

Abstract
Title National security policy formulation on illegal migrant workers

The objective of this research is to study the policy measures for organizing illegal
migrant workers. To study problems and obstacles in implementing policies and measures to
organize the illegal migrant workers into practice and to obtain feedback on the policy from the
analysis on the implementation of the policy measures on organizing illegal migrant workers to
the relevant persons.
The findings showed that it is well known that the economic and social development of
the country needed labor force which is one of the important factors in production. Thailand
currently, has high demand for labor force, in particular, workers in the agricultural sector and
lower levels. Due to the volume of the working age population of Thailand and increasing age of
dependency including birth rate is reduced. This causes lower levels of labor shortage and
Thailand relies on a large number of foreign workers.
To address this problem on a practical level, the policy must be flexiblefor migrant
workers that is to define as specific areas or exclusive economic zone for the community and
people in the area to get involve in policy formulation, lay down measures condition to carry for
labour group, to build understanding including incentives to staff in the operations level to
understand the policy and strictly practice and to proceed suppression measures taken by migrant
workers who fled into the city that did not meet the conditions. Adopt measures on returns system
appropriately and the protection of the employment status on the management level system of the
foreign workers or must be comprehensive developed, streamline the operation, establishment of
a comprehensive foreign workers management, create a channel and provide opportunity for
stakeholders in the migrant workers taking part in the management of migrant workers including
budget allocation, sufficient manpower.
In policy level, this must be given to the management of migrant workers in the
national agenda to prevent impact on the national security aspects of entire economy,
psychological society, politics, and environment.
