จากการที ประเทศไทยมีอัตราการเพิ มของนักท่องเที ยวเพิ มขึ0นในอัตราที สูงมาก
รวมทั0งมีการพัฒนาของการซื0อขายทางอินเตอร์เน็ต ทําให้มีการซื0อขายสินค้าและบริการทางการ
ท่องเที ยวเพิ มขึ0นอยางมาก ส ่ ่งผลให้มีการลงทุนที เกี ยวข้องกบการท ั ่องเที ยว โดยเฉพาะธุรกิจ
โรงแรมเพิ มขึ0นมาก แต่การขออนุญาตจดทะเบียนประกอบธุรกิจโรงแรม มีความเข้มงวด ทําให้
ผู้ประกอบการโรงแรมบางส่วน ไม่สามารถจดทะเบียนให้ถูกต้องได้ จึงดําเนินการโดยไม่มี
ใบอนุญาตประกอบกิจการโรงแรม
การวิจัยนี0 จัดทําขึ0นโดยมีวัตถุประสงค์เพื อศึกษาการประกอบกิจการโรงแรมผิด
กฎหมายในแหล่งท่องเที ยวสําคัญของไทย และหาแนวทางแกปัญหาการประกอบก ้ ิจการโรงแรมผิด
กฎหมาย โดยกาหนดขอบเขตของการวิจัย ด้านพื ํ 0นที ที ทําการศึกษารวมทั0งสิ0น ๖ แหล่งท่องเที ยว
ได้แก่ ๑. กรุงเทพมหานคร ๒. ภูเก็ต ๓. พัทยา ๔. เชียงใหม่ ๕. เกาะสมุย ๖. หัวหิน-ชะอํา
การวิจัยครั0งนี0 จะเป็ นการวิจัยเชิงคุณภาพ (Qualitative Research) โดยนําข้อมูลจํานวน
โรงแรมและห้องพักโรงแรมที จดทะเบียนอยางถูกต้อง เปรียบเทียบก ่ บจํานวนโรงแรมและห้องพักที ั
มีการนําเสนอขายทางอินเตอร์เน็ต เพื อนํามาวิเคราะห์ปัญหาและนําเสนอแนวทางแกไขปัญหา ้
ผลที ได้จากการวิจัย ทําให้ทราบปริมาณอุปทานของจํานวนห้องพักโรงแรม ใน ๖
แหล่งท่องเที ยวทราบสภาพปัญหาการประกอบกิจการโรงแรมผิดกฎหมาย ใช้เป็ นแนวทาง
แกปัญหา ้ ใช้ตัดสินใจเพื อลงทุนในธุรกิจโรงแรม และใช้ในการวางแผนส่งเสริมการท่องเที ยวของ
ไทย
ข้อมูลที สรุปได้จากงานวิจัย พบวา ผู้ที ประกอบก ่ ิจการโรงแรมอยางผิดกฏหมาย แบ ่ ่ง
ออกเป็ น ๒ กลุ่มใหญ่ๆ ดังนี0คือ ผู้ประกอบการโรงแรมที มีความประสงค์จะประกอบธุรกิจโรงแรม
อยางถูกต้อง แต ่ ่ไม่สามารถขอใบอนุญาตได้ และกลุ่มที ไม่ประสงค์จะขออนุญาตเป็ นโรงแรมที
ถูกต้องตามกฎหมาย แต่แอบแฝงเข้ามาประกอบธุรกิจโรงแรม
แนวทางการแกปัญหาในกลุ ้ ่มแรก คือต้องแกไขกฎหมายหลายฉบับ เพื อผ ้ อนคลาย ่
เงื อนไขในการขอใบอนุญาต ให้ผู้ประกอบการที มีความประสงค์จะจดทะเบียนอยางถูกต้อง ่
สามารถเข้ามาจดทะเบียนได้ ส่วนการดําเนินการสําหรับกลุ่มที สอง ต้องใช้มาตรการทางกฎหมาย
มาตรการทางภาษี และมาตรการทางการปกครอง ร่วมกนในการแก ั ปัญหา ้

ABSTRACT
Title Process to solve the problem of Illegal Hotel Operations for the Security
of Thai Tourism Industry

With the high increase rate of the number of arrival tourists to Thailand together with
the new development of online applications, these had attracted new investments for the hotel
business. But according to Thai laws, the application for the hotel license is very strict. So, many
new investors in the hotel business had operated their hotels without licenses and this problem
tends to be more and more serious and needed to find the conclusion to solve.
The objectives of this research are to study the supplies of number of hotels and hotel
rooms in 6 main tourist destinations in Thailand to know how serious is the problem and to find
the solutions to solve the problem. The target areas are
1. Bangkok 2.Phuket 3.Pattaya 4.Chiangmai 5.Samui 6.Huahin-Chaam
This research will be a qualitative research. The method of this research is to
compare of the number of legally registered hotels and hotel rooms in each tourist destination, to
the number of hotels and hotel rooms that can be searched out from Agoda.com which is one of
the top portal websites among the hotel and tourism online trading.
The results of this research will give the information how serious the problem of this
Illegal Hotel is, how much Oversupplies of the Hotel Rooms in 6 main tourist destination are. It
leads to the Conclusion that the Illegal Hotel Operations can be divided into 2 groups. Illegal
Hotels that intend to apply for the License but failed to meet the Criterions and Illegal Hotels
which are other business but operate as a Hotel without intention to apply for the License. The
Clues to solve the problems for each group will be different. For the first group, the Release for
some criterions must be considered so that many hotels can be qualified to apply for their
licenses. For the Second group, the Enforcement of the existing laws and some additional laws
are the Clues to solve the problem.
