ประเทศไทยมีการเปลีÉยนแปลงการปกครองจากระบอบสมบูรณาญาสิทธิราช มาเป็ นการ
ปกครองแบบระบอบประชาธิปไตยอนั มีพระมหากษตัริยท์ รงเป็นประมุขเมืÉอ ๒๔ มิถุนายน พ.ศ.
๒๔๗๕ มีรัฐธรรมนูญเป็ นกฎหมายสูงสุดของประเทศ กรุงเทพมหานครเป็ นทีÉตัÊงของสถานทีÉสําคญั
หลายแห่ง มีผูป้ระกอบการธุรกิจขนาดใหญ่จนถึงขาดเล็ก มีแรงงานทÊงในระบบและนอกระบบ ที ั É
ผา่ นมามกัมีกลุ่มทีÉมีความคิดเห็นต่างทางการเมืองชุมนุมประทว้งเสนอความคิดเห็นทางการเมือง ซÉึง
เกิดจากกลุ่มบุคคล ๒ กลุ่ม เรียกร้องให้กลุ่มของตนได้ประโยชน์มีการเคลÉือนยา้ยการชุมนุมนาํ
มาตรการและวิธีการทีÉผิดกฎหมายมาใช้เช่น การปิดถนน เพÉือก่อให้สถานการณ์รุนแรง ทาํให้เกิด
ความเสียหายต่อชีวิตและทรัพยส์ินของรัฐและประชาชน
ผวู้จิยัจึงไดท้ าํการศึกษาและวเิคราะห์ถึงพฤติกรรม เพÉอืนาํไปสู่การแกไ้ขปัญหา เพÉอืนาํไปสู่
มาตรการและวิธีทีÉเหมาะสมในการควบคุมการชุมนุมทางการเมืองตามกระบวนการของกฎหมาย
โดยไม่ส่งผลกระทบต่อความมนคงของประเท Éั ศ และความสงบเรียบร้อยและศีลธรรมอนัดีของ
ประชาชนโดยมีขอบเขตเนืÊอหา ดา้นสิทธิเสรีภาพในการชุมนุมประทว้ง ผลกระทบต่อประชาชนใน
พืÊนทีÉการชุมนุม โดยศึกษาวิจยัจากขา้ราชการลูกจา้ง พนกังานราชการผูป้ ระกอบการภาคเอกชน
แรงงานในระบบและนอกระบบ ผพู้กัอาศยั แต่อาจมีขอ้จาํกดในเรื ั Éองรูปแบบ และวธิีนาํ มาตราการณ์

จากการวจิยั พบวา่ การชุมนุมทางการเมืองมีการวางแผน และนาํยุทธศาสตร์มาใชอ้ยา่ งเป็น
ระบบ เช่น การปิดถนน บุกรุกสถานทีÉราชการ บงัคบั ให้หยดุ งาน ทาํลายทรัพยส์ินของทางราชการ
ส่งผลกระทบต่อเศรษฐกิจในภาพรวม เพÉือสร้างความกดดนั ให้ยอมปฏิบตัิตามขอ้ เรียกร้องทÊงนี ั Êยงั
พบวา่ ปัญหาอุปสรรคใ์นการแกไ้ขปัญหา คือไม่มีการบญั ญตัิกฎหมายเกีÉยวกบัการชุมนุมโดยเฉพาะ
การบงัคบั ใชก้ ฎหมายไม่เป็นไปตามทÉีบญั ญตัิไว้การบงัคบั บญั ชาและสัÉงการในการแกไ้ขปัญหาไม่
เป็นเอกภาพ ไม่มีการจาํกดัพÊนที ื Éการชุมนุมโดยเฉพาะ จนก่อให้เกิดการละเมิดสิทธิของผอู้ืÉน
