ในพื้นที่จังหวัดชายแดนภาคใต้

การวิจัยเรื่อง “การพัฒนาประสิทธิภาพการสืบสวนหลังเกิดเหตุระเบิดของกลุ ่ม
ผู้ก่อความรุนแรงในพื้นที่จังหวัดชายแดนภาคใต้” มีวัตถุประสงค์ เพื่อศึกษาปัจจัยที่เป็นปัญหา
อุปสรรคและแนวทางการพัฒนาประสิทธิภาพการสืบสวนหลังเกิดเหตุระเบิดในพื้นที่จังหวัดชายแดน
ภาคใต้ตลอดจนเสนอแนะแนวทางและน าข้อมูลที่ได้จากการวิจัยให้กับหน่วยงานที่ปฏิบัติงานในพื้นที่
อีกทั้งเสนอต่อรัฐบาลในการพิจารณาบังคับใช้กฎหมายในรูปแบบพิเศษในกระบวนการยุติธรรม เป็นการ
วิจัยเชิงคุณภาพ วิธีการด าเนินการวิจัยโดยการเก็บรวมรวมข้อมูล แนวคิด ทฤษฎี ผลงานวิจัยจาก
เอกสารที่เกี่ยวข้อง วิจัยภาคสนาม โดยการสัมภาษณ์เชิงลึก เจ้าหน้าที่ที่เกี่ยวข้องกับการสืบสวนหลัง
เกิดเหตุระเบิดในพื้นที่จังหวัดชายแดนภาคใต้และจากประสบการณ์ของผู้วิจัย ซึ่งเคยปฏิบัติราชการ
อยู่ในพื้นที่จังหวัดชายแดนภาคใต้เป็นระยะเวลานาน ขอบเขตของการวิจัย ศึกษาจากรูปแบบหรือ
ยุทธวิธีการก่อเหตุระเบิดในรูปแบบต่างๆ ของผู้ก่อความรุนแรง เพื่อให้ทราบถึงปัญหาอุปสรรคและ
เป็นการพัฒนาประสิทธิภาพของการสืบสวนหลังเกิดเหตุระเบิด การพิสูจน์ให้รู้ตัวผู้กระท าผิดและ
น าส่งพยานหลักฐานแก่ศาลในการพิจารณาลงโทษตามกฎหมายผลการวิจัยพบว่า ปัญหาด้านข้อกฎหมาย
เป็นปัญหาที่มีความส าคัญและจ าเป็นเร่งด่วนที่ควรจะต้องได้รับการแก้ไข ปัญหาด้านรองลงมาคือ
เจ้าหน้าที่ผู้ปฏิบัติการมีจ านวนไม่เพียงพอ ขาดประสบการณ์ ความรู้ความเข้าใจในกระบวนการ
สืบสวนหลังเกิดเหตุอย่างถ่องแท้อีกทั้งยังขาดแรงจูงใจและขวัญก าลังใจในการปฏิบัติงาน นอกจากนี้
เครื่องมือหรืออุปกรณ์พิเศษ รวมถึงกล้องวงจรปิด มีไม่เพียงพอและล้าสมัย ข้อเสนอแนะจากการวิจัย
ควรให้มีการบัญญัติประมวลกฎหมายวิธีพิจารณาคดีความมั่นคง เพื่อบังคับใช้เฉพาะพื้นที่ แยกจาก
การพิจารณาคดีอาญาทั่วไป การก าหนดให้พยานหลักฐานบางชนิด เช่น ค ารับสารภาพ การดักฟัง
ข้อมูลการติดต่อสื่อสาร การขอหรือให้ข้อมูลทางเทคนิค คอมพิวเตอร์ เครื่องมือสื่อสาร ให้มีการรับรอง
จากหน่วยงานที่เกี่ยวข้อง สามารถใช้เป็นพยานหลักฐานประกอบการพิจารณาคดีในชั้นศาลได้
นอกจากนี้ควรจัดสรรก าลังพลในแต่ละภาคส่วนให้มีเพียงพอต่อความต้องการ ควรจัดให้มีการพัฒนา
บุคลากร จัดให้มีการฝึกอบรม เพื่อทบทวนองค์ความรู้ ความช านาญเฉพาะด้านอย่างต่อเนื่อง ควรมี
การสร้างแรงจูงใจ เพื่อเป็นขวัญก าลังใจให้แก่เจ้าหน้าที่ผู้ปฏิบัติงาน เช่น ให้ค่าตอบแทนงานสอบสวน
ทางคดีความมั่นคงแตกต่างจากคดีอาญาปกติ และการให้สิทธิทวีคูณในการเลื่อนต าแหน่ง เป็นต้น
ควรจัดหาและจัดสรรงบประมาณในการซ่อมบ ารุงเครื่องมือหรืออุปกรณ์พิเศษและกล้องวงจรปิดให้มี
ความทันสมัยและเพียงพอต่อความต้องการ เพื่อน าไปสู่การพิสูจน์และรู้ตัวผู้กระท าผิด ติดตามจับกุม
ด าเนินคดี และส่งให้ศาลพิจารณาลงโทษผู้ก่อเหตุตามกระบวนการของกฎหมาย อันเป็นส่วนหนึ่ง
เพื่อน าความสงบมาสู่พื้นที่จังหวัดชายแดนภาคใต้ได้โดยเร็ว

The research of development of post - burdens investigation detective of violent
victims in Southern border provinces , purpose to study the factors that are the problem, obstacle
and the development of and effective investigation after an explosion in southern border of
Thailand. It also provides guidance and information from the research to agencies working in the
area. This also propose to the government to consider the application of special laws in the justice
system. This research is a qualitative research, methodology for conducting research by collecting
information, concepts, theories, research papers from relevant field research by in-depth interviews
with officials involved in post - explosion investigation in Southern border provinces and from the
experience of the researcher who has been working in the Southern border provinces for a long
time. Scope of research studies from the patterns or tactics of explosions in various from of
violence to identify the obstacle and to improve the effectiveness of investigations after an
explosion, proof of the offender and the submission of evidence to the court for the punishment
of the offender. The findings suggest that legal issues are the most important and urgent problem
that needs to be solved. The secondary problem was that the operator was inadequate, lack of
experience and understanding the post - incident investigation process, also lack of motivation and
morale in the worth. In addition, special tools or equipment including CCTV is not enough and
outdated. The research recommendations should provide for a law enforcement process to
ensure the use of specific areas separated from general criminal case. Assignment to certain types
of evidence, such as confessions, eavesdropping communication, requesting or providing technical
information on computer, communication on equipment, and accreditation from relevant
agencies can be used as evidence in a court case. In addition, there should be enough personal in
each sector to meet the needs, develop human resources, provide ongoing training to continually
review expertise. There should be incentives for staff morale, such as provide compensation for
security investigate different from normal criminal cases and the multiplication of promotion. Also,
should provide and allocate budgets for the maintenance of equipment or special equipment
and CCTV to be up - to - date and adequate to meet the needs, to lead to proof and realize the
action, follow up, arrest, prosecute, and send to the court to punish the offender by the legal
process. This is part of bringing peace to the Southern border of Thailand.
