การชุมนุมเรียกร้องสิทธิเป็นเสรีภาพที่คู่กับการปกครองในระบอบประชาธิปไตยอย่าง
แท้จริง หากสังคมขาดเสรีภาพในการชุมนุมย่อมถือไม่ได้ว่าสังคมนั้นปกครองโดยระบอบประชาธิปไตย
โดยในปัจจุบันสภาพทางการเมือง เศรษฐกิจ สังคมในประเทศ และสังคมโลกได้เปลี่ยนแปลงอย่าง
รวดเร็ว ก่อให้เกิดความขัดแย้งระหว่างสังคม ส่งผลให้มีการชุมนุมเพื่อเรียกร้อง สนับสนุน คัดค้านหรือ
แสดงความคิดเห็นในเรื่องใดเรื่องหนึ่งของประชาชนหรือกลุ่มบุคคลต่าง ๆ โดยการชุมนุมเรียกร้องโดย
สงบและปราศจากอาวุธ ถือว่าเป็นสิทธิเสรีภาพของประชาชนตามระบอบประชาธิปไตย โดย
รัฐธรรมนูญแห่งราชอาณาจักรไทย พ.ศ.2560 ได้บัญญัติรับรองเสรีภาพในการชุมนุมไว้ในมาตรา 44
ว่า “ บุคคลย่อมมีเสรีภาพในการชุมนุมโดยสงบและปราศจากอาวุธ ”
ปัจจุบันหน่วยงานที่ท าหน้าที่ในการควบคุมการชุมนุมเกิดจากการประกอบก าลังจาก
หลายหน่วยงานซึ่งไม่เคยฝึกร่วมกันมาก่อน ส านักงานต ารวจแห่งชาติควรจัดให้มีกองก ากับการที่
ประกอบด้วยก าลังพลท าหน้าที่ในการควบคุมฝูงชนโดยเฉพาะในทุก ๆ กองบัญชาการ เนื่องจากใน
การปฏิบัติหน้าที่ในการควบคุมการชุมนุมต้องพิจารณาถึงเรื่องของสิทธิของเด็กและสตรีซึ่งมาเข้าร่วม
ชุมนุมด้วย โดยต้องค านึงถึงการรักษาความสงบเรียบร้อยของกลุ่มบุคคลที่ออกมาใช้สิทธิของตนตามที่
รัฐธรรมนูญแห่งราชอาณาจักรไทยบัญญัติรับรองสิทธิไว้ และหน่วยงานดังกล่าวต้องมีความรู้ความ
เข้าใจข้อกฎหมายที่ใช้เกี่ยวกับการชุมนุมโดยเฉพาะ ก าลังพลในหน่วยต้องได้รับการฝึกอบรมทั้ง
หลักสูตรการควบคุมฝูงชน รวมถึงหลักสูตรการฝึกเตรียมความพร้อมเพื่อเข้าด าเนินการเมื่อเกิดความ
ไม่สงบเรียบร้อยภายในบ้านเมืองและเพื่อเป็นการเพิ่มประสิทธิภาพในการท างานของเจ้าหน้าที่ต ารวจ
สายปฏิบัติการและเนื่องจากการชุมนุมในแต่ละครั้งมักมีกลุ่มบุคคลไม่ทราบฝ่ายสามแฝงตัวรวมกับ
กลุ่มผู้เข้าร่วมชุมนุม จึงเห็นควรมีการฝึกอบรมเพิ่มเติมด้วย เช่น หลักสูตรชุดปฏิบัติการพิเศษ การ
ต่อต้านการก่อการร้ายสากล การช่วยเหลือผู้บาดเจ็บในสถานการณ์ต่าง ๆ เป็นต้น โดยในแต่ละกอง
ก ากับการต้องมีบุคคลที่มีความสามารถ เฉพาะด้านตามที่ปรากฏในแผนกรกฎ 52 ให้ครบถ้วนด้วย

The public gathering really is freedom rights coming with the democratic governance.
If the society lacks freedom in gatherings, it should not count that society is governed under
democratic governance. Due to the fast changing in political, economic, and both in and outside
social conditions of the country, it may cause the conflicts in societies that can lead to the
gathering demanding, supporting or opposing any views of peoples or groups through peaceful
and unarmed gathering that it should treat as people’s freedom rights in democratic governance
under the Kingdom of Thailand’ s B.E.2560 Constitution, which has stipulated in 44 Section that
“person should have freedom in peaceful and unarmed gathering”. Presently, the authorities
which are responsible for controlling the gathering coming from combined forces that are not
properly trained before. So, Royal Thai Police should establish the divisions in every bureau
consisting of personnel having duty in controlling the general public, when considering children
and women’ rights to join the gathering as well as the peace keeping of groups that come out to
use their rights in accordance with the Constitution. The units must have knowledge and
understanding in relevant laws involving the gathering. The unit’s personnel must be trained both
the crowd controlling course and the readiness to proceeding course, in case the unrests occur and
for the efficiency increasing of the patrol police officers. Because in each existing gathering,
there always have persons who cannot be identified concealing among the gathering participants.
In response to these causes, there should set up more training courses such as special operations
course, anti-international terrorists course and rescue the injured in any situations course etc. So,
each new division should recruit personnel that have special capability, as specified in
“Korakot52”plan.
