การวจิยัคร้ังน้ีมีวตัถุประสงค์เพื่อศึกษาวิเคราะห์ปัญหาการคุ้มครองทรัพย์สินทาง
ปัญญาและศึกษายุทธศาสตร์ แนวทางการคุ้มครองทรัพย์สินทางปัญญาในประเทศไทย ซึ่งเป็ นการ
วิจัยเชิงคุณภาพที่ค้นคว้า รวบรวมข้อมูลจากแหล่งต่าง ๆ ในเรื่องปัญหาการคุ้มครองทรัพย์สินทาง
ปัญญาการละเมิดเครื่องหมายการค้า ยุทธศาสตร์และแนวทางการคุ้มครองทรัพย์สินทางปัญญา จาก
ศึกษาพบว่า ปัญหาด้านข้อกฎหมาย กฎระเบียบ ที่มีความซ้ าซ้อนขอบเขตงาน ขาดกฎหมาย
กฎระเบียบสนับสนุน ปัญหาด้านการประดิษฐ์คิดค้นที่ขาดความรู้ทางเทคโนโลยีที่ทันสมัย
การน าเข้าสู่ระบบคุ้มครอง การน าทรัพย์สินทางปัญญาไปใช้ประโยชน์ในเชิงพาณิชย์และปัญหา
การบังคับสิ ทธิและระงับข้อพิพาท ผู้วิจัยพบว่ายุทธศาสตร์การสร้างทรัพย์สิ นทางปัญญา
ยุทธศาสตร์การใช้ประโยชน์จากทรัพย์สินทางปัญญาในเชิงพาณิชย์ ยุทธศาสตร์การคุ้มครอง

เป็นระยะ ๆ เพื่อให้ก้าวน าการเปลี่ยนแปลงข้อเสนอระดับปฏิบัติการส่งเสริมการวิจัยและพัฒนาที่
ตอบสนองความต้องการของตลาด ส่งเสริมระบบการศึกษา พัฒนาทรัพยากรมนุษย์ เร่งด าเนินการ
การจดทะเบียนให้เป็ นมาตรฐานสากล บูรณาการเชื่อมโยงฐานข้อมูล การวิจัยคร้ังต่อไปควร
ศึกษาวิจัยยุทธศาสตร์ด้านทรัพย์สินทางปัญญาในประเทศ สาธารณรัฐประชาธิปไตยประชาชนลาว
สหภาพเมียนมาร์ ราชอาณาจักรกัมพูชา และเวียดนาม เป็ นต้น เพื่อเป็ นกรณีศึกษาในการก าหนด

Abstract
Title Strategy to Enhance the Efficiency of Trademark Protection in
Thailand
Field Strategy

The aim of this research is to study the problems of trademark
protection and study the method of the strategy to protect the trademarks in
Thailand. This research is a qualitative research which researched and collected data
from different sources concerned with the problems, strategy and method of
trademark protection. According to the study, it was found that the differences
between rules and laws need supportive laws. The problems about invention need
knowledge of technology. There are different problems concerned with the study:
bringing the products into the protection, utilizing intellectual property for
commerce, and the problems about enforcement and dispute resolution. There is
the strategy of creating the intellectual property, the strategy of utilizing intellectual
property for commerce, the strategy of intellectual property protection, the strategy
of enforcement and dispute resolution, and the strategy of human resources. This
research suggests three levels of the strategy to enhance the efficiency of trademark
protection: short-time level, intermediate level, and long-term level. There should
be evaluation regularly. The suggestions as the operation level are supporting the
studies to improve and meet the markets’ demand, education system, developing
human resources, urgently making the copyright registration as the universal
standard, and linking all the information. Next research should be studied about the
intellectual property in other counties such as The Lao People's Democratic
Republic, Republic of the Union of Myanmar, the Kingdom of Cambodia, and
Vietnam gain the case studies for making policy of the intellectual property.
