เร่ือง ความคาดหวังต่อบทบาทของสมาชิกวุฒิสภาตามรัฐธรรมนูญปี พ.ศ. 2560

การศึกษาเรื่อง ความคาดหวังต่อบทบาทของสมาชิกวุฒิสภากับบริบทของสังคมไทย
มีวัตถุประสงค์เพ่ือ 1) ศึกษาปัญหาการทำหน้าที่ของสมาชิกวุฒิสภาในปัจจุบัน 2) ศึกษาผลกระทบ
อันเกิดจากวิธีการได้มาซึ่งหน้าที่และอำนาจของสมาชิกวุฒิสภา และ 3) เสนอแนะบทบาท อำนาจ
หน้าที่ และการได้มาซึ่งสมาชิกวุฒิสภาที่เหมาะสมกับบริบทของสังคมไทย โดยรวบรวมข้อมูลทุติยภูมิ
จากงานวิจัย เอกสารทางวิชาการและวรรณกรรมที่เกี่ยวข้อง ทั้งที่เป็นเอกสารจากประมวลกฎหมาย
และบทความของผู้ทรงคุณวุฒิที่ เกี่ยวข้อง และข้อมูลปฐมภูมิ จากการสัมภาษณ์นักกฎหมาย
นักการเมือง ผู้มีส่วนเกี่ยวข้อง และประชาชนในเขตกรุงเทพมหานครที่เป็นกลุ่มตัวอย่าง วิเคราะห์
ข้อมูลโดยใช้การวิเคราะห์เนื้อหา (Content Analysis) และการวิเคราะห์เปรียบเทียบ และสังเคราะห์
ข้อมูลทฤษฎี หลักการต่างๆ และวิเคราะห์ทางสถิติ สรุปผลการศึกษาได้ ดังนี้
ผลการวิจัยพบว่า ปัญหาการทำหน้าที่ของสมาชิกวุฒิ สภาตามรัฐธรรมนูญแห่ง
ราชอาณาจักรไทย พ.ศ. 2560 มีดังนี้ 1) ความไม่เป็นกลางทางการเมือง 2) วิธีการได้มาที่ไม่ถูกต้อง
และ 3) กรอบอำนาจหน้าที่ที่ไม่ชัดเจน ส่วนผลกระทบอันเกิดจากวิธีการได้มาซึ่งหน้าที่และอำนาจ
ของสมาชิกวุฒิสภามีดังนี้ 1) วิธีการได้มาซึ่งสมาชิกวุฒิสภา ได้แก่ (1) ความเสมอภาค และการมีส่วน
ร่วมของประชาชน ประกอบด้วย (2) ขั้นตอน และกระบวนการของการได้มาซึ่งสมาชิกวุฒิสภา
2) วิธีการได้มาซึ่งสมาชิกวุฒิสภา ได้แก่ (1) ความไม่ชอบด้วยหลักประชาธิปไตย (2) ที่มาของ
คณะกรรมการสรรหาสมาชิกวุฒิสภา และ 3) หน้าที่และอำนาจหน้าที่ของสมาชิกวุฒิสภาตามบท
เฉพาะกาล
ข้อเสนอแนะบทบาท อำนาจหน้าที่ และการได้มาซึ่งสมาชิกวุฒิสภาที่เหมาะสมกับบริบท
ของสังคมไทยจากการวิจัยควรมีดังนี้ 1) วิธีการได้มาซึ่งสมาชิกวุฒิสภาของประเทศไทย มีดังนี้
(1) ส่วนหนึ่งจึงควรมาจากการเลือกตั้งโดยอ้อม และ (2) ส่วนสมาชิกวุฒิสภาอีกส่วนหนึ่ง ให้มาจาก
การเลือกกันเองของกลุ่มบุคคล และ 2) หน้าที่และอำนาจของวุฒิสภา มีดังนี้ (1) การกลั่นกรอง
กฎหมาย ได้แก่ การพิจารณาร่างพระราชบัญญัติประกอบรัฐธรรมนูญ และการพิจารณาร่าง
พระราชบัญญัติ (2) การตรวจสอบ ได้แก่ การตั้งกระทู้ถาม การแต่งตั้งคณะกรรมาธิการสามัญและ
คณะกรรมาธิการวิสามัญ การขอเปิดอภิปรายโดยไม่มีการลงมติ การพิจารณาให้บุคคลดำรงตำแหน่ง
และการถอดถอนบุคคล และ (3) ในฐานะรัฐสภา ได้แก่ การแก้ไขเพ่ิมเติมวุฒิสภาตามรัฐธรรมนูญแห่ง
ราชอาณาจักรไทยพุทธศักราช 2560 และการให้ความเห็นชอบในเรื่องต่างๆ
ข้อเสนอแนะเชิงนโยบายมีดังนี้ 1) วุฒิสภาตามบทบัญญัติหลักของรัฐธรรมนูญแห่ง
ราชอาณาจักรไทย พุทธศักราช 2560 มาจากการเลือกตั้งโดยอ้อมของประชาชน โดยจัดให้มีการ
เลือกตั้งคณะกรรมการสรรหาสมาชิกวุฒิสภาจากประชาชน 2) ควรยกเลิกบทเฉพาะกาลในการ

กำหนดให้สมาชิกวุฒิสภามีหน้าที่และอำนาจในการเสนอชื่อร่วมกับสมาชิกสภาผู้แทนราษฎรในการ
เสนอชื่อต่อประธานรัฐสภาขอให้รัฐสภามีมติยกเว้น และ 3) ควรจัดให้มีการเลือกตั้งคณะกรรมการ
สรรหาสมาชิกวุฒิสภา โดยคำนึงถึงคุณสมบัติของคณะกรรมการ รวมถึงการแบ่งกลุ่มอาชีพโดยแท้จริง

Title Expectations on the Role of Senators under the 2017 Constitution
And the Context of Thai Society

The study of the expectations on the role of senators in the context of
Thai society aimed to 1) study the problems in the performance of the duties of the
senators at present, 2) study the impacts resulting from the methods of acquiring the
duties and powers of the senators, and 3) suggest roles, powers, duties, and the
selection of senators appropriated to the context of Thai society. Secondary data
were collected from research, academic documents and related literature, both from
legal codes and articles by related experts, and primary data from interviews with
lawyers, politicians, stakeholders and people in Bangkok who were a sample group.
Data were analyzed by using content analysis and comparative analysis, synthesis of
theoretical information, various principles and statistical analysis.
The research found that the problems in the performance of duties of
senators according to the Constitution of the Kingdom of Thailand B.E. 2560 were as
follows: 1) political bias, 2) improper methods of acquiring, and 3) unclear framework
of power and duties. The impacts resulting from the methods of obtaining the duties
and powers of senators were as follows: 1 ) The methods of acquiring senators
included (1) equality and public participation, which included (2) the steps and
processes for acquiring senators; 2 ) The methods of acquiring senators included (1 )
undemocratic principles, (2) the origin of the senator selection committee; and 3) the
duties and powers of senators according to the transitional provisions.
The recommendations for the roles, powers and acquiring senators that
were appropriate for the context of Thai society from the research should be as
follows: 1) the methods for acquiring senators in Thailand were as follows: (1) some
should be indirectly elected, and (2) some senators should be elected by groups of
people, and 2 ) the duties and powers of the senate were as follows: (1) legal
screening included consideration of draft organic laws and consideration of draft bills,
(2) inspection included the raising of questions, the appointment of standing
committees and special committees, the request for a debate without a vote, the
consideration of appointing a person to a position, and the removal of a person, and
ง
(3) as parliament included amending the senate in accordance with the Constitution
of the Kingdom of Thailand B.E. 2560 and giving approval on various matters.
The policy recommendations were as follows: 1) the senate, according to
the main provisions of the Constitution of the Kingdom of Thailand B.E. 2560 , was
indirectly elected by the people, with organizing the election of the Senate Selection
Committee from the people, 2) there should be abolish of temporary provision on
the duty and power of senators to jointly nominate candidates with members of the
House of Representatives to the President of the National Assembly to request the
National Assembly to pass a resolution exempting and 3) there should be an election
of the Senate Selection Committee, taking into account the qualifications of the
committee members, including the true division of occupations.
