การศึกษาครั้งนี้ มีวัตถุประสงค์เพื่อศึกษาสภาพปัญหาและผลกระทบต่อประชาชน
ต่อการเพิ่มโทษปรับ ตามพระราชบัญญัติแก้ไขเพิ่มเติม ประมวลกฎหมายอาญา (ฉบับท่ี 26)
พ.ศ. 2560 กรณีความผิดต่อร่างกายตามประมวลกฎหมายอาญา มาตรา 295 - 300 เพื่อน าไปสู่การ
ก าหนดและเสนอแนะแนวทางการก าหนดค่าปรับปัจจุบัน ท่ีจะต้องเป็นการลงโทษท่ีเหมาะสมกับ
ตัวบุคคลมากกว่าความผิด ได้สัดส่วนกับการกระท าของผู้กระท าความผิด และทดแทนความเสียหาย
ให้แก่ผู้เสียหายจากการที่ผู้กระท าความผิดได้ท าให้เกิดความเสียหายข้ึน
กฎหมายและกระบวนการยุ ติธรรมในบริบทของยุทธศาสตร์ชาติเป็นโครงสร้าง
พื้นฐานเชิงยุทธศาสตร์ ทิศทางการขับเคล่ือนการพัฒนากฎหมายและกระบวนการยุติธรรมภายใต้
ยุทธศาสตร์ชาติ ก าหนดให้กฎหมายเป็นปัจจัยส าคัญในการพัฒนาประเทศ มีเป้าหมายหลัก
ให้กฎหมายและกระบวนการยุติธรรมเป็นไปเพื่อประโยชน์ส่วนรวมของประเทศ แผนแม่บทภายใต้
ยุทธศาสตร์ชาติประเด็น กฎหมายและกระบวนการยุติธรรมจึงถูกจัดท าขึ้น เพื่อเป็นกลไกส าคัญ
ตอบสนองต่อการขับเคล่ือนยุทธศาสตร์ชาติด้วยการมุ่งเน้นให้กฎหมายมีความเป็นพลวัตท่ีสอดคล้อง
เหมาะสมกับบริบทต่าง ๆ เปล่ียนแปลงไปและเป็นไปตามความต้องการ ของประชาชน และ
มีกระบวนการยุติธรรมท่ีเคารพสิทธิมนุษยชนและปฏิบัติต่อประชาชนโดยเสมอภาค มีความเป็นกลาง
น่าเช่ือถือ โปร่งใส ตรวจสอบได้ ส่งผลให้เป้าหมายการพัฒนายุทธศาสตร์ชาติในทุกด้านบรรลุ
ความส าเร็จในการสร้างสังคมไทยให้เป็นสังคมท่ีเป็นธรรม ลดความเหล่ือมล้ าในทุกมิติ และเป็นไป
เพื่อประโยชน์ต่อส่วนรวมของประเทศเพื่อส่งเสริม ให้ประชาชนทุกภาคส่วนในสังคมมีโอกาสได้รับ
ประโยชน์จากการพัฒนาประเทศอย่างเท่าเทียม เป็นธรรมและท่ัวถึง

Objective of this research is the problems and impacts on the public
studying from the increase in fines (penalties) under the Criminal Code Amendment
Act (No. 26) B.E. 2560 in the case of offense against human body under the Criminal
Code, Sections 295 - 300, in order to determine and propose guidelines for determining
the current fines, which must be a punishment that is more appropriate for the
individual than the offense, proportionate to the offender's actions, and compensate
for the damages to injured person from the damages caused by the offender.
Laws and justice processes in the context of the national strategy are
strategic infrastructure. The direction of driving the development of laws and justice
processes under the national strategy determines that laws are important factors in
national development. The main purpose is to enhance laws and justice processes
benefit to country as a whole. The master plan under the national strategy on laws
and justice processes was therefore developed to be an important mechanism to
respond to driving the national strategy by focusing on making laws dynamic,
consistent with various contexts, changing, and conform to the purpose of the
public, and having a justice process that respects human rights and treats the public
equally, neutrally, reliable, transparently, and verifiable, resulting in the successful
achievement of the goals of national strategy development in all aspects in creating
social justice for Thailand. Reduce inequality in all dimensions and for the benefit
of country as a whole to promote people from all sectors of society to have the
opportunity to benefit from national development equally, fairly and comprehensively.
