ประชาชน และกรมป่าไม้ในโครงการแก้ไขปัญหาการอยู่อาศัยและท ากิน
ในพื้นที่ป่าสงวนแห่งชาติ

ท่ีอยู่อาศัย คือ ส่ิงท่ีจ าเป็นส าหรับมนุษย์ ในขณะท่ีประเทศไทยมีพื้น ท่ีเท่าเดิม
แต่จ านวนประชากรมีจ านวนเพิ่มขึ้น ส่งผลท าให้ประชาชนบางส่วนบุกรุกและถือครองพื้นท่ีป่า
โดยไม่ได้รับอนุญาต ซึ่งรัฐบาลได้เห็นถึงความส าคัญในการแก้ไขปัญหาประชาชนท่ีไร้ท่ีดินท ากินและ
อยู่อาศัย โดยในปี พ.ศ. 2528 กรมป่าไม้ได้ให้สิทธิ์ท ากิน (สทก.) แก่ราษฎรเพื่อช่วยเหลือราษฎรท่ีมี
ความจ าเป็นในการครองชีพ ให้สามารถเข้าท ากินในเขตป่าสงวนแห่งชาติได้โดยไม่เดือดร้อน ในเวลา
ต่อมาเมื่อวันท่ี 7 พฤศจิกายน 2557 ได้มีมติอนุมัติหลักการจัดท่ีดินท ากินให้ชุมชน ตามนโยบาย
รัฐบาลในลักษณะแปลงรวมโดยมิให้กรรมสิทธิ์ แต่อนุญาตให้เข้าท าประโยชน์ในท่ีดินของรัฐเป็นกลุ่ม
หรือชุมชนตามหลักเกณฑ์และเงื่อนไขคณะกรรมการนโยบายท่ีดินแห่งชาติก าหนด และได้มีมติ
คณะรัฐมนตรี เมื่อวันท่ี 26 พฤศจิกายน 2561 โดยมีเป้าหมายและมาตรการแก้ไขปัญหาการอยู่อาศัย
และท ากินในพื้นท่ีป่าไม้ (ทุกประเภท)
การศึกษาวิจัยครั้งนี้วัตถุประสงค์เพื่อศึกษาสภาพแวดล้อมปัญหาของโครงการแก้ไข
ปัญหาการอยู่อาศัยและท ากินในพื้นที่ป่าสงวนแห่งชาติ เพื่อน าไปวิเคราะห์ ค้นคว้า ประเมิน ค้นหา
แนวทาง สร้างรูปแบบการยอมรับ และการมีส่วนร่วม ระหว่างประชาชนกับกรมป่าไม้ ในโครงการแก้ไข
ปัญหาการอยู่อาศัยและท ากินในพื้นท่ีป่าสงวนแห่งชาติ โดยใช้รูปแบบวิธีการสัมภาษณ์ในลักษณะเป็น
การสัมภาษณ์แบบกึ่งโครงสร้าง (Semi-structure Interview ) โดยอาศัยแนวการสัมภาษณ์
(Interview Guide) เป็นเครื่องมือในการสัมภาษณ์มีรูปแบบต่าง ๆ จากการศึกษา พบปัญหาความ
ล่าช้าในขั้นตอน และขบวนการต่าง ๆ อาจเป็นเพราะระเบียบ ข้อกฎหมาย ท่ีมากเกินความจ าเป็น
ความไม่ชัดเจนในด้านของพื้นท่ี เจ้าหน้าท่ียังขาดประสบการณ์ยังไม่ทราบขอบเขตอ านาจของตน
รวมถึงจ านวนของเจ้าหน้าท่ีต่อพื้นท่ีความรับผิดชอบไม่สอดคล้องกัน ซึ่งปัญหาการอนุมัติให้ใช้พื้นท่ี
ล่าช้า ท าให้ผู้ร่วมโครงการขาดความมั่นใจ และคณะอนุกรรมการชุดอื่น ๆ ไม่สามารถเข้าไป
ด าเนินการได้ ทางผู้วิจัยจึงจัดท าโมเดลการมีการยอมรับการมีส่วนร่วมและพัฒนาระหว่างประชาชน
และกรมป่าไม้ในโครงการแก้ไขปัญหาการอยู่อาศัยและท ากินในพื้นท่ีป่าสงวนแห่งชาติ โดยให้
หน่วยงานท่ีดูแลพื้นท่ีของรัฐ ส ารวจการถือครองและจัดหาพื้นท่ี และให้หน่วยงานผู้ดูแลพื้นท่ีออก
ระเบียบ กฎหมาย หลักเกณฑ์ และแนวทาง สามารถแก้ไขปัญหาเรื่องสิทธิชุมชนได้อย่างครอบคลุม
และชัดเจนท้ังในเรื่องการรับอนุญาตและสิทธิในการบริหารจัดการท่ีดิน พร้อมด าเนินขั้นตอนต่าง ๆ
จนเสร็จส้ิน เพื่อลดขั้นตอนการปฏิบัติ และความรวดเร็วในการด าเนินงาน โดยหน่วยงานผู้ดูแลพื้นท่ี
สามารถบูรณาการร่วมกับหน่วยงานอื่น ๆ ในการสนับสนุนชุมชนเพื่อให้ผู้ร่วมโครงการมีชีวิต
