การศึกษาน้ีมีวัตถุประสงค์ ๑. เพื่อศึกษาปัญหาและอุปสรรคในการปฏิรูปองค์กร
ต ารวจไทย ที่ผ่านมาโดยเฉพาะการแก้ไขปรับปรุงกฎหมายเกี่ยวกับต ารวจซึ่งได้ด าเนินการมาแล้ว
๒. เพื่อวิเคราะห์รูปแบบปัญหาที่เกิดข้ึนในองคก์รตา รวจของไทยในมิติต่าง ๆ และ ๓. เพื่อศึกษาแนว
ทางการปฏิรูปด้านอื่น ๆ ที่มีความจ าเป็ นจะต้องด าเนินการในอนาคต เพื่อให้บรรลุวัตถุประสงค์
ของการปฏิรูปองค์กรต ารวจไทยมากที่สุด งานวิจยัน้ีใช้รูปแบบการวิจัยเชิงคุณภาพ (Qualitative
Research) โดยท าการศึกษาข้อมูล ข้อเท็จจริ ง แนวคิด และทฤษฎีที่เกี่ยวข้อง จากกฎหมาย กฎ
ระเบียบ ข้อบังคับ เอกสารของทางราชการ บทความทางวิชาการ รายงานการศึกษาดูงาน และ
การสัมภาษณ์ผู้ที่มีความรู้หรื อประสบการณ์รวมถึงข้อมูลที่ผู้วิจัยได้จากการสังเกตการณ์และ
รวบรวมในฐานะเจ้าหน้าที่ผู้มีอ านาจหน้าที่และความรับผิดชอบ
ผลการศึกษาพบว่ากระบวนการปฏิรูปต ารวจตามเจตนารมณ์ของรัฐธรรมนูญ
มีระยะเวลาด าเนินการยาวนานหลายปีและปัจจุบันยังไม่เห็นผลลัพธ์ของการเปลี่ยนแปลงมากนัก
เนื่องจากจ าเป็ นต้องใช้เวลาในการแสดงประสิทธิผล ส าหรับการปฏิรูปต ารวจเชิงนโยบายต้องอาศัย
ความเอาใจใส่ของผู้มีอ านาจและผู้บังคับบัญชาเป็ นหลักในการขับเคลื่อนนโยบายตามหลัก 3Pและ
ผลการศึกษาทา ให้ทราบถึงปัญหาที่เกิดข้ึนในส านักงานตา รวจแห่งชาติในหลากหลายมิติซ่ึงมี
สาเหตุมาจากปัจจัยทางสังคมและโครงสร้างองค์กรต ารวจและเนื่องจากการปฏิรูปต ารวจด้วยกฎหมาย
ยังไม่ครอบคลุมในทุกประเด็นการปฏิรูปและคงเหลืออีกหลายประเด็นที่จ าเป็ นต้องด าเนินการ
ในอนาคต กฎหมายจึงเป็นเพียงเครื่องมือชนิดหน่ึงในการปฏิรูปเท่าน้ัน โดยสา นักงานตา รวจ
แห่งชาติควรด าเนินการปฏิรูปเชิงนโยบายควบคู่ไปกับการปฏิบัติตามแนวทางของกฎหมายเพื่อให้
การปฏิรูปประสบผลส าเร็จมากที่สุด รวมถึงเรื่องที่กฎหมายได้วางหลักการปฏิรูปต ารวจไว้แบบ
กว้าง ๆ ซ่ึงจา เป็นตอ้งมีการกา หนดกรอบการดา เนินการและข้นั ตอนการปฏิบตัิให้ชัดเจนเพื่อให้
บรรลุวัตถุประสงค์ตามเจตนารมณ์ของกฎหมายต่อไป ท้งัน้ีผู้วิจัยเสนอแนะให้มีการศึกษาเพิ่มเติม
เกี่ยวกับการปฏิรูปโครงสร้างต ารวจของไทยจากแบบรวมศนู ยอ์า นาจเป็นกระจายอา นาจให้ทอ้งถิ่น
โดยศึกษาจากรูปแบบต ารวจของต่างประเทศที่มีประสิทธิภาพ เช่น ญี่ปุ่ นและเยอรมณี เป็ นต้นข

The objectives of this study are 1. to study problems and obstacles of the past reform
of the Thai police, particularly the amendment to the police law 2. to analyze the organizational
issues that occur in the Royal Thai Police in various dimensions and 3. to study other reform
approaches that are necessary to be taken in the future, to achieve the objective of overall police
reform as much as possible. This research performed qualitative research methods by studying
information, facts, concepts, theories, laws, rules, regulations, books, government documents,
academic articles, and visit reports, and interviewing an expert in the related field. The study also
included information that the researcher obtained from observation and gathered as an officer
with authority and responsibility.
The study found that the process of police reform by the Constitution costed many
years to finish. Moreover, we may not see much of the reform outcomes in the present because the
process caused by the law must take time in producing effectiveness. For policy-based reforms,
the attention and the empathy of political authorities and senior police officers are mainly required
to drive the reforms based on the 3P principle. In addition, the result of the study revealed several
organizational problems occurring in the Royal Thai Police in a variety of dimensions, which are
caused by social factors and the structure of the police organization itself. Since police reform
through the process of the law has not covered all issues, other essential approaches that have not
been implemented will need to be pursued in the future. Therefore, the police law is therefore onlyone
of many measures for police reform. The Royal Thai Police should carry out policy-basedreforms and
meanwhile follow guidelines of the police law, to make the overall reform as comprehensive as
possible. Issues which the police law prescribing a broad principle to implement require a clear
framework and procedure to achieve the objective of the law. With regard, this study suggested
future research may focus on the change in the Thai police structure from centralization to
decentralization by studying effective international police models such as Japan and Germany.ค
