เรื่อง แนวทางการจัดท าประมวลกฎหมายการผังเมืองและควบคุมอาคารของประเทศไทย

การวิจัยมีวัตถุประสงค์เพื่อจัดท ากฎหมายต้นแบบพร้อมเสนอแนวทางการจัดท า
ประมวลกฎหมายการผังเมืองและควบคุมอาคารของประเทศไทย โดยใช้วิธีวิทยาการวิจัยเชิงคุณภาพ
ประกอบด้วยการวิจัยเอกสาร สัมภาษณ์เชิงลึก ในการเก็บรวบรวมและวิเคราะห์ข้อมูล
การวิจัยพบว ่ามีกฎหมายหลักที ่เกี ่ยวข้องกับการพัฒนาเมืองที ่ส าคัญ คือกฎหมาย
ผังเมือง กฎหมายจัดรูปที ่ดินเพื ่อพัฒนาพื้นที ่ กฎหมายควบคุมอาคาร กฎหมายขุดดินและถมดิน
มีโครงสร้างองค์กรใช้อ านาจรวมทั้งมีการบริหารกฎหมายในลักษณะที่มีหลายคณะกรรมการรวมทั้งมี
หลายระดับ มีปัญหาในการบูรณาการกับหลายภาคส่วน จึงมุ่งจัดระบบกฎหมายทั้งสี่ฉบับให้อยู่ในรูป
ของประมวลกฎหมาย เพื่อให้เกิดความเชื่อมโยง รวมทั้งปรับปรุงรูปแบบการบริหารกฎหมายในเชิง
โครงสร้างให้กระชับเพื่อเกิดประสิทธิภาพในการด าเนินการ รวมทั้งลดภาระงบประมาณของหน่วยงาน
ทั้งยังเป็นการลดภาระของประชาชนที่จะต้องเข้ามามีส่วนเกี่ยวข้องด้วย
ผลจากการวิจัยได้เสนอกฎหมายต้นแบบโดยมีโครงสร้างของร่างประมวลกฎหมายการ
ผังเมืองและการควบคุมอาคารของประเทศไทย มีบทบัญญัติ 308 มาตรา ประกอบด้วย 7 ลักษณะ
พร้อมทั้งเสนอแนวทางในการเสนอร่างประมวลต่อหน่วยนโยบายเพื่อน าไปสู่การประกาศใช้เป็น
กฎหมายต่อไป
ข้อเสนอแนะจากการวิจัยได้ก าหนดให้มี2 เป้าหมายของยุทธศาสตร์ 4 วัตถุประสงค์ของ
ยุทธศาสตร์ 8 ตัวชี้วัดและ 8 กลยุทธ์ และได้ก าหนดวิสัยทัศน์ของยุทธศาสตร์ (vision) เพื่อการ
จัดท าประมวลกฎหมายการผังเมืองและควบคุมอาคารของประเทศไทยอันจะน าไปสู่ “ชุมชนน่าอยู่
ผู้คนปลอดภัยในการใช้อาคาร” ซึ่งเป็นการก าหนดแนวทางที่สอดคล้องกับแนวปฏิบัติของการบริหาร
ราชการแผ่นดิน จะท าให้ลดความเสี่ยงที่จะท าให้ภารกิจในการเสนอร่างประมวลกฎหมายฯ
มีอุปสรรค จึงได้เน้นการสร้างความเห็นพ้องหรือ“การสร้างมติสาธารณะ” ด้วยการให้ประชาชนเห็นพ้อง
เป็นส าคัญ พร้อมกับให้ส่วนราชการที่เป็นกลไกส าคัญในด าเนินกลยุทธ์ให้มีส่วนได้รับทราบข้อมูลอย่าง
รอบด้านตั้งแต่ต้น ส าหรับด้านเครื่องมือ (means) จะมีแผนระยะสั้นระบุโครงการพร้อมกิจกรรม และ
ก าหนดหน่วยงานรับผิดชอบระดับกระทรวงและระดับกรม เพื่อร่วมขับเคลื่อนให้บรรลุเป้าประสงค์
ของการสร้างเมืองน่าอยู่ ประชาชนมีความปลอดภัยในการใช้อาคาร อันจะท าให้เกิดการร่วมมือในการ
ปฏิบัติจนน าไปสู่ความส าเร็จข

Title Guideline for legislation of the city planning and building control
code of Thailand

The purpose of this research is to develop a model law and to propose
a guideline for the preparations of Thailand's Town Planning and Building Regulations
Code. Qualitative research methodology is conducted; documentary research and indepth interviews are the tools for data collection and analysis. The research found
that there are major laws related to urban development, including the city planning
law, land readjustment law, building control law and land excavation and land filling law.
Until now, the enforcement of the laws is a duplicated task conducted by several
agencies with overlapping procedures. Furthermore, the integration of laws’
implementation with other sectors appeared to be complicated. This research aims
to systematize the above laws into a code of law to ensure better integration. Also,
restructuring the ponderous legal administration manner to be more effective and
reducing the financial burden of the agency. This could ease the burden for the
people involved as well.
The research results proposed a model law based on the structure of the
draft Code of Town Planning and Building Control of Thailand, containing 308
provisions, consisting of 7titles. The research also proposes guidelines to be proposed
as a draft code to policy agencies to have them enacted.
The recommendations from the research are the determinations of
2 strategic goals, 4 strategic objectives, 8 indicators, and 8 strategies as well as the
determination of a strategic vision for the preparation of Thailand's town planning
and building control code that will lead to “Vibrant community, people are safe to
use the building.” In addition, in order to reduce the risk of possible obstacles in
proposing the draft Code, it is necessary to emphasize on creating consensus or
“creating public consensus” by acquiring people’s agreement. At the same time,
government agencies that are important mechanisms for implementing strategies
should initially be thoroughly informed. In regard to the means, the research
proposes a short-term plan with specific project activities, along with establishing
agencies in charge at the ministry and department levels to jointly achieve the goal
of “Vibrant community, people are safe to use the buildings.”ค
