เรื่อง แนวทางการพัฒนาการกำกับดูแลกิจการน้ำมันเชื้อเพลิงตาม
พระราชบัญญัติคุมน้ำมันเชื้อเพลิง พ.ศ. ๒๕๔๒ และที่แก้ไขเพิ่มเติม พ.ศ.
๒๕๕๐ ด้วยระบบ E-Fuelpermit :กรณีศึกษาเฉพาะบริษัท พีทีจี เอ็นเนอยี

การศึกษาวิจัยในครั้งนี้มีวัตถุประสงค์ เพื่อศึกษาลักษณะการดำเนินงานร่วมกันระหว่าง
หน่วยงานต่างๆทั้งภาครัฐและเอกชน ในการกำกับดูแลการประกอบกิจการน้ำมันเชื้อเพลิง เพื่อศึกษา
วิเคราะห์ ปัญหาอุปสรรคและปัจจัยที่เกี่ยวข้อง ต่อการดำเนินการแจ้ง อนุญาต ควบคุม ตรวจสอบ
กิจการน้ำมันเชื้อเพลิง เพื่อใช้ในการพัฒนาระบบ E-Fuelpermit และเพื่อเสนอแนวทาง การ
พัฒนาการกำกับดูแลกิจการน้ำมันเชื้อเพลิงด้วยระบบ E-Fuelpermit ซึ่งเป็นการนำเทคโนโลยีระบบ
การจัดการข้อมูลอิเล็กทรอนิกส์เข้ามาใช้ร่วมกันทั้งหน่วยงานภาครัฐและเอกชนต่อไป โดยใช้ระเบียบ
วิธีวิจัยเชิงคุณภาพ (Qualitative Research) โดยมีขอบเขตกลุ่มเป้าหมายที่จะดำเนินการศึกษา คือ
หน่วยงานภาครัฐที่เกี่ยวข้องกับการกำกับดูแลกิจการน้ำมันเชื้อเพลิง และกลุ่มผู้ประกอบกิจการน้ำมัน
เชื้อเพลิง ๒ กลุ่ม คือ หน่วยงานภาครัฐได้แก่ กรมธุรกิจพลังงาน กระทรวงพลังงาน พลังงานภูมิภาค
หรือองค์การปกครองส่วนท้องถิ่น ผู้ประกอบกิจการน้ำมันเชื้อเพลิง ๒ ประเภท และ กิจการน้ำมัน
เชื้อเพลิงประเภทที่ ๓ ทั้งนี้ ยังมีการสัมภาษณ์กลุ่มผู้บริหารระดับสูงของหน่วยงานต่างๆที่เกี่ยวข้อง
หรือ มีบทบาทในการกำหนดนโยบายหรือตัดสินใจปรับปรุงพัฒนาการกำกับดูแลกิจการน้ำมันเชื้อเพลิง
ผลการศึกษาพบว่า ลักษณะการดำเนินงานร่วมกันระหว่างหน่วยงานต่างๆทั้งภาครัฐและ
เอกชน ในการกำกับดูแลการประกอบกิจการน้ำมันเชื้อเพลิง ในปัจจุบันยังคงใช้ลักษณะการ
ดำเนินงานในรูปแบบเดิมมาโดยตลอด คือ การจัดเตรียมเอกสาร และสำเนาหลายชุดเพื่อเป็นหลักฐาน
ในการขึ้นทะเบียน จดแจ้ง หรือขอใบอนุญาตกิจการน้ำมันเชื้อเพลิงควบคุมตามกฎหมาย โดยที่กรม
ธุรกิจพลังงานเป็นหน่วยงานของรัฐที่มีบทบาทหน้าที่ในการกำกับดูแลด้านความปลอดภัยของการเก็บ
รักษา การใช้ การขนส่ง และการจัดจำหน่ายน้ำมันเชื้อเพลิง ตามหลักเกณฑ์ วิธีการและเงื่อนไขที่ออก
ตามพระราชบัญญัติควบคุมน้ำมันเชื้อเพลิง พ.ศ.๒๕๔๒ และกฎหมายที่ออกตามพระราชบัญญัตินี้
ประกอบกับการกำกับดูแลการประกอบกิจการควบคุมบางส่วน ได้มีการโอนถ่ายภารกิจให้แก่องค์กร
ปกครองส่วนท้องถิ่น ตามพระราชบัญญัติกำหนดแผนและขั้นตอนการกระจายอำนาจให้แก่องค์กร
ปกครองส่วนท้องถิ่น พ.ศ.๒๕๔๒ และบางส่วนยังได้มีการมอบหมายให้ราชการส่วนภูมิภาคด้วย

ปัญหาอุปสรรคและปัจจัยที่เกี่ยวข้อง ต่อการดำเนินการแจ้ง อนุญาต ควบคุม ตรวจสอบ
กิจการน้ำมันเชื้อเพลิง เกิดจากความซับซ้อนและซ้ำซ้อนของเอกสารและ ลำดับขั้นตอนต่างๆในการ
ดำเนินงาน ทำให้กระบวนการมักมีความล่าช้า เกิดช่องว่างในการสื่อสารทั้งหน่วยงานภาครัฐด้วยกัน หรือ เอกชนก็ตาม และ ณ ปัจจุบันยังไม่มีนโยบายใดๆ ที่เน้นการสนับสนุนให้นำเทคโนโลยีต่างๆมาใช้
ในการประกอบกิจกรรมต่างๆ
การพัฒนาการกำกับดูแลกิจการน้ำมันเชื้อเพลิงด้วยระบบ E-Fuelpermit เป็นการนำ
เทคโนโลยีระบบการจัดการข้อมูลอิเล็กทรอนิกส์เข้ามาใช้ร่วมกันทั้งหน่วยงานภาครัฐและเอกชน ระบบ
E-Fuelpermit อยู่ในรูปแบบของแพลตฟอร์มโปรแกรมคอมพิวเตอร์ในรูปแบบเว็บไซต์ หรือ แอป
พลิเคชันที่สามารถติดตั้งภายในองค์กร (On-Premise) ในเซิร์ฟเวอร์ขององค์กร และบนระบบคลาวด์
(On-Cloud) ที่พัฒนาขึ้นมาใหม่โดยเฉพาะเพื่อช่วยในการทำงานในองค์กร ที่เป็นลักษณะกิจการน้ำมัน
เชื้อเพลิงควบคุมตามกฎหมาย โดยเฉพาะอย่างยิ่งกิจการควบคุมประเภทที่ ๓ ซึ่งต้องมีใบอนุญาต
ประกอบกิจการควบคุม นวัตกรรมนี้ถูกออกแบบมา เหมาะสำหรับ เจ้าหน้าที่ที่เกี่ยวข้องกับด้าน

ควบคุม ซึ่งนอกจากงานที่กล่าวมาข้างต้นแล้ว ยังสามารถใช้เป็นช่องทางในการสื่อสาร ระหว่างภาครัฐ
และเอกชนหรือหน่วยงานต่างๆที่เกี่ยวข้อง ใช้ในการตรวจสอบสถานะใบอนุญาต สถานะคำขอต่างๆ
รวมถึงตรวจสอบขั้นตอนต่างๆในการทำงานเพื่อลดข้อผิดพลาดในการทำงาน ซึ่งนอกจากนวัตกรรมนี้
จะมีส่วนช่วยในการเปลี่ยนแปลงรูปแบบการทำงานจากการทำงานบนกระดาษมาเป็นการทำงานด้วย
ระบบอิเล็กทรอนิกส์แล้ว การจัดเก็บหลักฐานการทำงาน การอนุมัติ และการตัดสินใจต่างๆของคณะ

This research study has the objectives To study the nature of joint
operations between various agencies, both public and private sectors. in supervising
the fuel business to study and analyze Obstacles and Related Factors To proceed with
notifying, permitting, controlling, inspecting the fuel business To be used in the
development of the E-Fuelpermit system and to propose guidelines. The development
of fuel industry supervision with the E-Fuelpermit system, which is the use of electronic
data management system technology to be used together by both government and
private sectors. By using qualitative research methodology, the target group to conduct
the study is government agencies involved in the regulation of fuel industry. and two
groups of fuel business operators: government agencies, namely Department of Energy
Business ministry of energy regional energy or local government 2 types of fuel oil
business operators and 2 types of fuel oil business. There were also interviews with
high-level executives of various agencies involved or having a role in setting policies or
making decisions to improve the supervision of the fuel industry.
The study found that nature of joint operations between various agencies,
both public and private sectors in supervising the fuel business At present, it still uses
the same operating style as always, which is the preparation of documents. and several
copies as evidence for registration, notification or requesting a license for a regulated
fuel business according to law Whereas the Department of Energy Business is a
government agency responsible for supervising the safety of storage, utilization,
transportation and distribution of fuel in accordance with the rules, procedures and
conditions issued by law. together with the supervision of some controlled business

at present there is no policy. which focuses on supporting the use of various
technologies in various activities
The development of fuel industry supervision through the E-Fuelpermit
system is an electronic data management system technology used by both government
and private sectors. The E-Fuelpermit system is in the form of a computer program
platform in the form of a website or app. Apps can be installed within the organization
(On-Premise) on the corporate server. and on the cloud (On-Cloud), newly developed
especially to help work in the organization which is a legally controlled fuel business
