บทคัดย่อ:
เรื่อง แนวทางการกำกับดูแลองค์กรปกครองส่วนท้องถิ่นโดยกระทรวงมหาดไทย

การวิจัยนี้มีวัตถุประสงค์เพื่อศึกษาแนวคิด ทฤษฎี พัฒนาการการบริหารราชการแผ่นดิน
ของราชการส่วนท้องถิ่นตั้งแต่อดีตถึงปัจจุบัน การจัดตั้งองค์กรปกครองส่วนท้องถิ่น ลักษณะการกำกับ
ดูแล บทบัญญัติแห่งกฎหมายที่กำหนดความสัมพันธ์ขององค์กรปกครองส่วนท้องถิ่นกับราชการส่วนกลาง
โดยวิเคราะห์บทบาทของกระทรวงมหาดไทยในการกำกับดูแลเทศบาลจากตัวอย่างผลการดำเนินงาน
สถิติการใช้อำนาจ และปัญหาที่เกิดขึ้นจากการดำเนินงานของกระทรวงมหาดไทย ตลอดจนนำเสนอ
แนวทางในการเพิ่มประสิทธิภาพการกำกับดูแลเทศบาลโดยกระทรวงมหาดไทยตามกรอบยุทธศาสตร์ชาติ
พ.ศ. 2561-2580 และกลไกความร่วมมือระหว่างรัฐและภาคส่วนต่างๆ
ผลการวิจัยพบว่า ในภาพรวมกระทรวงมหาดไทยมีบทบาทสำคัญในการกำกับดูแลเทศบาล โดยกำกับ
ดูแลเพียงเท่าที่จำเป็น เพื่อคุ้มครองประโยชน์ของประชาชนในท้องถิ่นหรือประโยชน์ของประเทศ
เป็นส่วนรวม เป็นการกำกับดูแลด้วยความชอบกฎหมาย (Principle of Legality) ทั้งการกระทำและนิติกรรม
ทางปกครอง ภายใต้หลักการ “ไม่มีกฎหมาย ไม่มีอำนาจ” และ “เมื่อมีอำนาจ ต้องไม่ขัดกับกฎหมาย”
โดยสามารถจำแนกการกำกับดูแลเทศบาลของกระทรวงมหาดไทยออกเป็น 2 กรณี คือ การกำกับดูแลโดยตรง
ได้แก่ การกำกับดูแลบุคคล การกำกับดูแลองค์กร การกำกับดูแลการกระทำ และการกำกับดูแลการคลัง
การกำกับดูแลโดยอ้อม ได้แก่ การใช้เงินอุดหนุนเป็นมาตรฐานในการกำกับดูแล และการใช้สัญญามาตรฐาน
เป็นมาตรการกำกับดูแล
ข้อเสนอแนะการวิจัย คือ การเพิ่มประสิทธิภาพแนวทางการกำกับดูแลเทศบาลโดยบูรณาการ
จากทุกภาคส่วนจำแนกเป็น ระดับนโยบายได้แก่ การปรับปรุงบทบาทกระทรวงมหาดไทยในการกำกับดูแล
เทศบาล การจัดตั้งศาลปกครองแผนกคดีท้องถิ่น การจัดตั้งคณะกรรมการกำหนดมาตรฐานกลาง
ในการจัดบริการสาธารณะขององค์กรปกครองส่วนท้องถิ่นโดยผู้แทนจากส่วนราชการที่เกี่ยวข้อง ในระดับพื้นที่
ได้แก่ การพัฒนาแนวทางการกำกับดูแลโดยสำนักงานการตรวจเงินแผ่นดิน การเพิ่มบทบาทการกำกับดูแล
โดยภาคประชาชนและภาควิชาการ ทั้งนี้ เพื่อให้การกำกับดูแลเทศบาลโดยกระทรวงมหาดไทย
เป็นไปตามเจตนารมณ์ของกฎหมายและความต้องการของประชาชนในพื้นข

This research aims to study the concepts, theories, and developmental
progression of governance on the local level in Thailand from the past to the present.
It examines the establishment of local administration, the nature of supervision,
legal provisions governing the relationship between local administration and Central
Administration. The analysis focuses on the role of the Ministry of Interior in supervision
municipalities, based on examples of operational outcomes, power utilization statistics,
and challenges resulting from the Ministry of Interior. Additionally, it proposes strategies
to enhance the efficiency of supervision for Municipalities under the Ministry of Interior
in accordance with the National strategy of Thailand 2018-2037 and mechanisms
for cooperation between various government sectors.
The study result reveals that, overall, the Ministry of Interior plays a vital role
in supervising municipalities, ensuring oversight as necessary to protect the interests
of local communities or the overall interests of the nation. This supervision is carried out
in accordance with the principle of legality, encompassing both actions and administrative
sanctions. The oversight of municipalities by the Ministry of Interior can be categorized
into two scenarios: direct oversight involving supervision of individuals, organizational
oversight, oversight of actions, and oversight of financial matters; and indirect oversight
involving the use of subsidies as a standard for supervision and the use of standardized
contracts for oversight.
The research recommendations include the effectiveness of strategies for
supervision municipalities through integration from all sectors. At the policy level,
this involves refining the role of the Ministry of Interior in supervising municipalities,
establishing local court divisions, forming central standard-setting committees for local ค
administration with representatives from relevant government sectors. At the local level,
this includes developing oversight strategies by the State Audit Office of the Kingdom
of Thailand, increasing the role of citizens and academic sectors in oversight.
These initiatives aim to align the oversight of municipalities by the Ministry of Interior with
the spirit of the law and the desires of the local communities.ง
