มาตรา ๗๗ วรรคสอง ก าหนดว่าก่อนการตรากฎหมายทุกฉบับ รัฐพึงจัดให้มีการรับฟังความคิดเห็น
ของผู้เกี่ยวข้อง วิเคราะห์ผลกระทบที่อาจเกิดขึ้นจากกฎหมายอย่างรอบด้านและเป็นระบบ รวมทั้ง
เปิดเผยผลการรับฟังความคิดเห็นและการวิเคราะห์นั้นต่อประชาชน และน ามาประกอบการพิจารณา
ในกระบวนการตรากฎหมายทุกขั้นตอน
การวิจัยครั้งนี้มีวัตถุประสงค์เพื่อศึกษาขั้นตอนและกระบวนการจัดท าร่างกฎหมายของ
ฝ่ายบริหาร วิเคราะห์ปัญหาในการจัดท าร่างกฎหมายของฝ่ายบริหาร และหาแนวทางการเพิ่ม
ประสิทธิภาพกระบวนการรับฟังความคิดเห็นของประชาชนการจัดท าร่างกฎหมายของฝ่ายบริหาร
ผลของการวิจัยที่ได้รับจากการรวบรวมข้อมูลเอกสาร และจากการสัมภาษณ์
ผู้ทรงคุณวุฒิท าให้ได้รับทราบปัญหาและแนวทางการเพิ่มประสิทธิภาพกระบวนการรับฟังความคิดเห็น
ของประชาชนในการจัดท าร่างกฎหมายของฝ่ายบริหาร
เพื่อให้การจัดท าร่างกฎหมายของฝ่ายบริหาร ก่อนน าสู่การพิจารณาของสภาเป็น
ร่างกฎหมายที่มีความสมบูรณ์มากที่สุดและสามารถใช้บังคับได้ตามที่มุ่งหวัง ฝ่ายบริหารซึ่งประกอบด้วย
หน่วยงานภาครัฐและคณะรัฐมนตรีต้องให้ความส าคัญกับเรื่องขั้นตอนการรับฟังความคิดเห็นอันเป็น
ข้อก าหนดตามรัฐธรรมนูญแห่งราชอาณาจักรไทย พ.ศ. ๒๕๖๐ มาตรา ๗๗ วรรคสอง โดยให้หน่วยงาน
ของรัฐจัดรับฟังความคิดเห็นอย่างจริงจัง ด้วยการจัดหลายวิธีร่วมกันในช่วงระยะเวลาที่เหมาะสม ไม่ใช่
การรับฟังความคิดเห็นผ่านเว็บไซต์เพียงอย่างเดียว โดยเฉพาะร่างกฎหมายที่มีสาระส าคัญยากต่อการ
เข้าใจและเกี่ยวข้องกับกลุ่มบุคคลจ านวนมาก และควรมอบหมายให้มีหน่วยงานรับผิดชอบการจัดรับฟัง
ความคิดเห็นอย่างจริงจัง พร้อมทั้งสนับสนุนงบประมาณ และอุปกรณ์ในการด าเนินงาน ซึ่งอาจ
มอบหมายให้เป็นภารกิจของสถาบันพระปกเกล้า ส านักงานปลัดส านักนายกรัฐมนตรี หรือ ส านักงาน
คณะกรรมการการเลือกตั้ง โดยไม่จ าเป็นต้องจัดตั้งหน่วยงานใหม่

Enactment oflawsunder the Constitution of the Kingdom of Thailand B.E. 2560 (2017), Section
77, paragraph two, stipulates that before enactment of new laws, the Statemustarrange to havea hearing
of the opinions from relevant persons. Analyzingthe impacts that may arise from the law in a comprehensive
and systematic manner. The State must disclose the results of the hearing and analysis to the public.
The Statemusttake into consideration in every step of the new law enactment process.
This research aimed at studyingthe process of drafting a new administrative law, analyzing
problems in the preparation of the administrative law's draftingand findingways to increase the efficiency of
the public hearing process.
The results of the research obtained from compilation of documented data, interviews with
expertshelp reduce theproblems and improve guidelines for enhancing the efficiency of the public hearing
process in the preparation of a new administrative laws.
In order to have the most comprehensive and enforceable laws, government agencies and
the cabinets must pay attention to the hearing procedures, which are the provisions of the Constitution of
the Kingdom of Thailand B.E. 2017, Section 77, paragraph two. They should seriously listen to opinions from
multiple sources, not just opinions from the website, in particular, in the draft laws that are difficult to
understand and involve various groups of people. The governmentshould assign the hearing and processing
of establishing a new law to a government agency. This agency will be responsible for organizing a public
hearing, analyzing the impact of the new law. There will be no need to establish a new agency,
the governmentcan choose from many existingagencies that have been established. Once the government
has chosen the agency, the governmentmust support the agency by appropriate funding, personal, tools
and equipment agency needed to complete the task. The King Prajadhipok's Institute Office, Permanent
Secretary of the Prime Minister's Office or the Election Commission of Thailand is one of the best fit to take
on this responsibility.
