การวิจยัในคร้ังน้ีมีวตัถุประสงคเ์พื่อศึกษาปัญหาและผลกระทบที่เกิดจากการให้สิทธิ
แก่คนต่างดา้วถือครองห้องชุด และศึกษาแนวทางแกป้ ัญหาที่เกิดจากการให้สิทธ์ิแก่คนต่างดา้วถือ
ครองห้องชุดในประเทศไทย พ้ืนที่การศึกษาวจิยัศึกษาเฉพาะการถือครองอาคารชุดของคนต่างดา้ว
ในประเทศไทย ในพ้ืนที่กรุงเทพมหานคร และจังหวัดชลบุรีเท่าน้นั การศึกษาวิจัยคร้ังน้ีเป็ นการวิจัย
เชิงคุณภาพ โดยใชเ้ครื่องมือในการเก็บรวบรวมขอ้ มูลโดยการสัมภาษณ์แบบเจาะลึกกบัผใู้ห้ขอ้ มูล
หลักเป็ นส าคัญ โดยเน้นการสัมภาษณ์จากผู้ทรงคุณวุฒิที่เป็ นนักวิชาการ ตัวแทนภาคเอกชน
ตวัแทนหน่วยงานภาครัฐและภาคประชาชน จ านวน ๑๐ ราย และศึกษาข้อมูลจากเอกสาร สถิติ
รายงาน งานวิจัยที่เกี่ยวกบัการถือครองอสังหาริมทรัพยข์องคนต่างดา้วในประเทศไทย ซึ่งใช้เวลา
ศึกษาวิจัยจ านวน ๗ เดือน เริ่มต้งัแต่เดือน พ.ย. ๒๕๖๒ – พ.ค. ๒๕๖๓
จากการศึกษาวิจยั พบว่า การอนุญาตให้คนต่างด้าวถือครองที่ดิน และห้องชุดใน
ประเทศไทย ก่อให้เกิดปัญหาต่อประเทศท้งัในด้านความมนั่ คง เศรษฐกิจ สังคม การทุจริตของ
ข้าราชการความเหลื่อมล้า ทางสังคม เพราะมีบุคคลกลุ่มหน่ึงที่สามารถกระทา การหรือทา ธุรกิจได้
แมว้่ากฎหมายห้ามจึงเกิดปัญหาในการบงัคบั ใช้กฎหมาย ทา ให้คนเสื่อมศรัทธาต่อการบงัคบั ใช้
กฎหมายของประเทศก่อให้เกิดการทุจริตคอรัปชนั่ และส่งผลให้ประเทศเกิดการสูญเสียรายได้ทางภาษี
เนื่องจากคนต่างดา้วเขา้มาท าธุรกรรมในลักษณะธุรกรรมอ าพรางภาครัฐจึงไม่สามารถตรวจสอบ
ที่มาของรายได้ที่แท้จริงได้
จากการศึกษาวิจัยผู้วิจัยได้ให้ข้อเสนอแนะ โดยประเทศไทยควรมีการแกไ้ขกฎหมาย
ที่เกี่ยวขอ้งเพื่อให้ครอบคลุมการทา ธุรกรรมของคนต่างด้าวให้ครอบคลุมถึงการที่คนต่างด้าวมีอา นาจ
บริหารหรือครอบงา กิจการที่คนต่างดา้วต้งัข้ึนมาโดยใชค้ นไทยเป็นผอู้า พรางการทา ธุรกรรม ควรมี
การจดั ต้งัหน่วยงานเฉพาะทา หน้าที่กา กบัและควบคุมการท าธุรกรรมลักษณะตัวแทนอ าพรางของ
คนต่างดา้วโดยให้มีหน้าที่ด าเนินการติดตาม และตรวจสอบเกี่ยวกบัการทา ธุรกรรมอา พรางของคน
ต่างดา้วในประเทศ และประสานงานกบั หน่วยงานที่เกี่ยวขอ้งเพื่อตรวจสอบการกระทา ความผิด
รวมถึงควรเร่งสร้างจิตสา นึกใหค้ นไทยใหเ้กิดความหวงแหนแผน่ ดิน ส่งเสริมให้ประชาชนมีความรู้
เกี่ยวกบัวิธีการและรูปแบบการทา ธุรกรรมอา พรางของคนต่างดา้วและตระหนกัถึงผลเสียที่จะเกิด
แก่สังคมไทยในดา้นต่าง ๆ โดยเฉพาะในดา้นเศรษฐกิจที่อาจเกิดข้ึนในอนาคต

Title Impact from permission of alien’s possession of apartment in thailand

This research has the objective of studying the problems and impacts from
permission of alien’s possession of apartment and studying the solution of problems resulting
from permission of alien’s permission of apartment in Thailand. The area of this study is
specifically for possession of alien in Thailand, just in case of Bangkok and Chonburi. This
research is qualitative research by which the researcher uses in-depth interview with informant as
main tool. At any rate, the researcher conducts the interviews with experts who are academicians,
public and private sector representatives of ๑ ๐ cases and studies from documents and statistics
from research of real estate possession of alien in Thailand that takes ๗ months, from Nov. BE
2562 – May BE 2563.
From the research, it is found that permission of alien to possess land and apartment
in Thailand causes problems to the country in several aspects ranging from security, economy,
society, corruption of government officers to social disparity. Since, there is a group of people
that can act or operate business even there are laws prohibiting. This results in law enforcement
problems and causes people to lose faith in legal enforcement of the country, corruption and
the country loses income from taxes, hence the alien involved in concealed transactions and
the government cannot inspect income source.
From this study, the researcher suggests that Thailand should amend related laws
that would include alien’s transactions for sweeping the authorities of such businesses that may
employ Thai people for concealing transactions. Also, it should have specific agency established
for conducting and controlling the concealed transactions of alien by which it should follow and
inspect concealed transactions of alien in the country and coordinate with other related agencies
for inspecting the crime. What’s more, it should cultivate burgeoning conscience of Thai people
to cherish motherland and educate people in methods and approaches of alien’s concealed
transactions and aware of drawbacks resulting in Thai society in several aspects especially
in economy issues that could arise in the future.
