หากย้อนดูประวัติศาสตร์คนไทยกับคนกัมพูชามีชะตาร่วมกันในการเผชิญกับลัทธิอาณา
นิคมตะวันตกในคริสต์ศตวรรษที่ ๑๙ อังกฤษและฝรั่งเศสได้ขยายนโยบายล่าเมืองข้ึนมาทาง
ตะวนัออกองักฤษครอบครอง พม่า มาเลเซีย สิงคโปร์ส่วน ฝรั่งเศสยึดครอง เวียดนาม ลาวและ
กัมพูชา แม้ว่าไทยจะรักษาเอกราชไว้ได้แต่ก็ต้องสูญเสียดินแดนให้แก่เจ้าอาณานิคมเท่าที่เหลืออยู่
ในปัจจุบันเมื่อพ้นยุคล่าอาณานิคมประเทศต่างๆในอินโดจีนได้คืนสู่ความเป็นเอกราชอีกคร้ังหน่ึง
ความขัดแยง้ใหม่ๆได้เกิดข้ึนจนกลายเป็นความไม่ไวว้างใจจนถึงปัจจุบันคือปัญหาเส้นเขตแดน
ท้งัน้ีเพราะสนธิสัญญาที่องักฤษและฝรั่งเศสได้ทา ไวช้่วงเป็นเจ้าอาณานิคมไม่เป็นไปตามกฎหมาย
ระหว่างประเทศท าให้สนธิสัญญาที่ไม่เป็นธรรมน้ีกลายเป็ นระเบิดเวลา(Time Bomb) ที่พร้อม
ท างานทุกเมื่อและเป็นเงื่อนไขที่อ่อนไหวด้านชาตินิยมของชาติต่างๆปัญหาเขตแดนระหว่างไทยกับ
กัมพูชาที่มีเขตแดนติดต่อกันท้ังทางบกและทางทะเลก็เป็ นปัญหาที่ก่อให้เกิดการกระทบกระทั่ง
ระหว่างประเทศท้งัสอง
ท้ังน้ีปัญหาเส้นเขตแดนทางทะเลระหว่างไทยและกัมพูชานับว่าเป็นปัญหาที่มีความ
อ่อนไหวและอาจน าไปสู่ความขดัแยง้ระหว่างประเทศไดด้ ังน้ันการวิจยัคร้ังน้ีมีวัตถุประสงค์อยู่ ๓
ประการคือ เพื่อศึกษาสาเหตุของปัญหาเขตแดนทางทะเลของไทยและกัมพูชา เพื่อศึกษาการ
แก้ปัญหาเขตแดนทางทะเลของไทยและกัมพูชาในปัจจุบันและเพื่อน าเสนอแนวทางการแก้ปัญหา
เขตแดนทางทะเลของไทยและกัมพูชาการศึกษาในคร้ังน้ีเป็ นการศึกษาในเชิงคุณภาพ(Qualitative Research) ด้วยการส ารวจ
เอกสาร (Documentary research) โดยใช้การเก็บรวบรวมข้อมูลที่เกี่ยวกับ สภาพของปัญหาที่ส่งผล
กระทบต่อเขตแดนทางทะเล และความสัมพันธ์ระหว่างไทยกับกัมพูชา โดยศึกษาจากแนวคิด
ทฤษฎีเอกสาร ต าราและบทความทางวิชาการต่าง ๆ รวมท้งัเอกสารจากทางราชการ หน่วยงานที่
ปฏิบัติราชการสนามตามแผนป้องกันประเทศ ทางชายแดนไทย –กัมพูชาและนา ขอ้มูลที่ไดท้ ้งัหมด
มาวิเคราะห์ (Analysis) สังเคราะห์(Synthesis) ประมวลเป็ นแนวทางการแก้ปัญหาเขตแดนทาง
ทะเลของไทยและกัมพูชา
ผลการวิจัยพบว่ามีปัญหามาจากการเมืองระหว่างประเทศ,การไม่ยอมรับการประกาศเขต
ไหล่ทวีปของท้ังสองประเทศ, ปัญหาที่ต้ังของหลักเขตที่๗๓และ ปัญหาการตีความสนธิสัญญา
ก าหนดเขตแดนทางทะเลระหว่างไทย-กัมพูชาที่แตกต่างกัน
ข้อเสนอแนะจากการวิจัยต้องใช้การเจรจาเพื่อแก้ปัญหาพ้ืนที่ทับซ้อนทางทะเลไทยกัมพูชาโดยเจรจาเพื่อแบ่งเขตแดนและเจรจาเพื่อแสวงประโยชน์ร่วมกนั หรือพ้ืนที่พฒนาร่วม( ั JDA)
เพื่อก่อให้เกิดประโยชน์ต่อประเทศและประชาชนของท้งัสองประเทศ

ABSTRACT

Looking back through the history, Thailand and Cambodia had same destiny by
facing with colonialism of western country in 19th century. England and France spread
their Colonize to Eastern country which resulted in conquering Mynmar, Malaysia and
Singapore by England and possession of Vietnam, Laos and Cambodia by France.
Although Thailand was able to retain their sovereignty, some parts of the country were
losed and the rest still remain till now. After ending of the colonial era, Indochaina
countries got their sovereignty back, yet new conflict was introduced which is
boundary problem that expanded problem to mistrust on others nowadays. The treaties
which were made by England and France were not illegal by the international laws, so
these injustice treaties became time bomb that was ready to explode in anytime and
also became a sensitive issue for states parties. Boundaries problem between Thailand
and Cambodia, who have connecting border both on land and sea, caused wounding
among both countries.
Although, boundaries problem between Thailand and Cambodia is a sensitive
issue which may led to the conflict between the two countries, this research have 3
caution objectives, not to expand more on conflict, which are to study on sea border
problem of Thailand, to study on guideline for solving maritime border problem
between Thailand and Cambodia in the past and in present time, and to present
guideline for maritime border problem solving in next decade.
This research use qualitative methodology that focus on documentary research
that focus on the state of problem that effects on maritime border and relationship
between Thailand and Cambodia. After gathering data from concepts, theories,
documents, books, articles and government reports from active units that operate on
national defense plan on Thailand-Cambodia side, researcher analyze all data then
synthesize and process to form conclusion on guideline for solving maritime border
problem between Thailand and Cambodia.
The result of this research show that cause of the problem come from
international politics, denying on announcement of continental shelf area by both
countries, the problem of boundary mark number 73 and the problem of different
interpretation of treaties that define maritime boundary between Thailand and
Cambodia.
The recommendation of this research is to use negotiation as a tool for solving
the problem of maritime overlapping area between Thailand and Cambodia. The major
topics are on specifying the area of each country, joint exploitation or joint
development area that should maximize benefits for both countries.
