เรื่อง มาตรการด าเนินการกับเด็กและเยาวชนที่ก่ออาชญากรรมร้ายแรง

ปัญหาการก่ออาชญากรรมเป็นภัยคุกคามต่อชีวิต ร่างกาย ทรัพย์สินและการอยู่ร่วมกัน
ในสังคมโดยสงบสุข โดยเฉพาะการก่ออาชญากรรมของเด็กและเยาวชนในสังคมไทยนับวันมีแต่
จะทวีความรุนแรงเพิ่มมากขึ้นเรื่อย ๆ และเป็นภาระหน้าที่ส าคัญของรัฐที่ต้องคิดหามาตรการ
เพื่อป้องกันและแก้ไขปัญหาเหล่านี้ให้หมดสิ้นไปหรือลดน้อยลงมากที่สุดเท่าที่จะท าได้ แต่ด้วย
เหตุผลว่าเด็กและเยาวชนถือเป็นทรัพยากรบุคคลอันทรงคุณค่าของประเทศชาติซึ่งในวันข้างหน้า
เขาเหล่านั้นจะต้องมาทดแทนผู้ใหญ่ประกอบกับการกระท าความผิดของเด็กและเยาวชนส่วนหนึ่ง
เพราะเหตุย่อหย่อนด้านความรู้ ด้านสติปัญญา ขาดประสบการณ์ชีวิต ซึ่งหากจะด าเนินคดีและ
ลงโทษเด็กและเยาวชนให้เบ็ดเสร็จเด็ดขาดทีเดียวก็ดูไม่จะไม่สอดคล้องกับสภาพปัญหา จึงเกิด
แนวความคิดว่าการด าเนินคดีและการลงโทษเด็กและเยาวชนควรมีลักษณะเฉพาะมิใช่เพียงแค่
เพื่อการลงโทษเช่นเดียวกับผู้ใหญ่เท่านั้น แต่ยังจะต้องหาหนทางเยียวยาแก้ไขและฟื้นฟูเด็กและเยาวชน
ที่กระท าความผิดให้เป็นก าลังส าคัญของชาติในอนาคตด้วย การศึกษาวิจัยครั้งนี้เป็นการศึกษา
ถึงทฤษฎีและแนวความคิดในการลงโทษผู้ก่ออาชญากรรม โดยชี้ให้ถึงลักษณะการด าเนินคดีและ
ลงโทษเด็กหรือเยาวชนที่ก่ออาชญากรรมว่ามีแนวความคิดหรือหลักทฤษฎีใดที่สนับสนุนอยู่
เบื้องหลังและมีความแตกต่างกับผู้ใหญ่ อย่างไร และปัจจัยหรือข้อจ ากัดที่มีผลกระทบต่อการ
ลงโทษเด็กหรือเยาวชนที่ก่ออาชญากรรม รวมถึงแสวงหามาตรการที่เหมาะสมส าหรับด าเนินการ
กับเด็กและเยาวชนที่ก่ออาชญากรรมร้ายแรง จากการศึกษาวิจัยพบว่า การลงโทษเด็กและเยาวชน
ที่ก่ออาชญากรรมไม่ว่าจะเป็นอาชญากรรมร้ายแรงเพียงใดหรือไม่ก็ตาม กฎหมายไทยได้น าหลัก
ทฤษฎีการลงโทษเพื่อแก้ไขฟื้นฟูมาประยุกต์ใช้เช่นเดียวกับนานาอารยประเทศ และการลงโทษเด็ก
และเยาวชนที่ก่ออาชญากรรมร้ายแรงให้หนักขึ้นเป็นเพียงมาตรการหนึ่งของการแก้ไขปัญหาเด็ก
และเยาวชนที่ก่ออาชญากรรมและเป็นการแก้ไขปัญหาที่ปลายเหตุเท่านั้น แต่ยังมีมาตรการ
ที่เหมาะสมรวมถึงข้อเสนอแนะอื่น ๆ อันจะช่วยป้องกันและแก้ไขปัญหาเด็กและเยาวชนที่ก่อ
อาชญากรรมในสังคมไทยได้อย่างยั่งยืน ทั้งนี้ต้องอาศัยความร่วมมือจากบิดามารดา ผู้ปกครอง ครู
อาจารย์ตลอดจนสถานศึกษาทั้งของภาครัฐและเอกชนที่จะต้องร่วมมือกันอย่างแข็งขัน

Crime is a threat to life, body, property and coexistence in society. In particular, the
crimes of children and youth in Thai society have been increasing ever since. And it is an
important obligation of the state to think about measures to prevent and resolve these problems as
much little as possible. But for the reason that children and youth are the valuable human
resources of the nation, in the future, they will have to replace the adults and the juvenile
delinquency, partly because of the lack of intellectual knowledge. If the prosecution and
punishment of children and youth are absolutely decisive, it does not seem to be consistent with
the problem. The concept that juvenile prosecution and punishment should be unique, not just
punishment, is the same as adults. It will also have to find ways to remedy and rehabilitate
juvenile delinquents as a major force in the future. This study is the study of the theories and
concepts of punishment for criminals. By pointing to the nature of litigation and punishment of
juvenile offenders, what are the underlying ideas and theories behind the scenes and how are they
different from adults, and the factors or constraints that affect the punishment of children and
youth crime, including seeking the appropriate measures to deal with juvenile delinquents. From
the study found that the juvenile delinquent commits a crime, whether it is a serious crime or not.
Thai law has introduced the theory of punishment for rehabilitation as applied to the civilization.
And the juvenile delinquency of crimes is more than just a measure of juvenile delinquency and a
solution to the problem. There are also appropriate measures and other suggestions that will help
to prevent and solve the problem of juvenile delinquents in Thai society. It requires the
cooperation of parents, teachers, as well as educational institutions of both the public and private
sectors that will be required to collaborate vigorously.
